RESOLUTION
The Minutes of the Development Assessment Unit Meeting of Council held on 13 September 2016 be confirmed.
ITEM-2 DA NO. 835/2015/HB/B - SECTION 96 (1A) MODIFICATION TO A MULTI DWELLING HOUSING DEVELOPMENT - LOT 4 DP 501479, NO. 2 MARIE STREET, CASTLE HILL
RESOLUTION
The Section 96 Application be approved subject to the following amendments to non- active conditions of consent:
1. Condition Nos. 1 and 10 be deleted and replaced as follows:

The development being carried out in accordance with the approved plans and details submitted to Council, as amended in red, stamped and returned with this consent. No work (including excavation, land fill or earth reshaping) shall be undertaken prior to the issue of the Construction Certificate, where a Construction Certificate is required
The amendments in red denote the landscaping plan for landscaping purposes only.

10. Retention of Trees
All trees are to be retained with remedial work to be carried out in accordance with Council’s Protection of Existing Trees Condition and the additional specifications as described in Addendum 2 Tree Inspection Report prepared by Treehaven Environscapes, dated 28 April 2016.
The additional specifications as described in Addendum 2 Tree Inspection Report are in relation to the extended Alfresco Area of Unit 5. These specifications include:
 The alfresco area is to be placed above the existing ground level on isolated brick piers with a concrete footing. The placement of piers shall be constructed as to avoid severing tree roots greater than 50mm in diameter.
 The alfresco floor is to be timber decking.
 Trees should be mulched with 100mm thick covering of Leaf and Chip mulch.
 A Project Arborist shall be appointed to supervise and document the excavation of the piers and placement of tree protection fencing.

RESOLUTION
The Development Application be refused for the following reasons:
1. The proposal is considered unsatisfactory in regard to the objective of the RU2 Rural Landscape zone and Clause 5.9 of Local Environmental Plan 2012 as the proposal has undertaken unauthorised tree removal and has resulted in disturbance and degradation of the biodiversity values of the site, including the removal of endangered native vegetation and fauna habitat (Section 79C(a)(i) of EP and A Act, 1979).
2. The proposal is considered unsatisfactory in regard to the requirements of Development Control Plan Part B Section 1 – Rural in relation to ensuring that acoustic impacts will not be created (Section 79C(a)(iii) of EP and A Act, 1979).
3. The proposal will result in an unacceptable bush fire hazard and is not supported by the NSW Rural Fire Service (Section 79C(b) and (c) of EP and A Act, 1979).
4. The proposal has resulted in unauthorised clearing of the native vegetation and has significantly disturbed and degraded the biodiversity values of the site, including the removal of endangered native vegetation and fauna habitat(Section 79C(b) of EP and A Act, 1979).
5. The application has not adequately addressed acoustic impact from the sawmill use (Section 79C(b) and (c) of EP and A Act, 1979).
6. The application has not adequately addressed management of the site in regard to the storage of chemical and the prevention of contamination of soil, land and water (Section 79C(b) and (c) of EP and A Act, 1979).
7. The application has not adequately addressed waste management, including waste generation and waste collection(Section 79C(b) and (c) of EP and A Act, 1979).
8. The application has not adequately addressed BCA matters in regard to fire safety, in particular in relation to existing and proposed works, toilets and amenities, egress and structural engineer’s details in regard to the structural adequacy of the existing building(Section 79C(b) and (c) of EP and A Act, 1979).
