MOVED BY COUNCILOR HODGES AND SECONDED BY COUNCILOR COX THAT the Minutes of the Regular Council Meeting held on July 12, 2022 be confirmed. Council prohibits access to items 11 and 12 in accordance with the table below and section 11(2) of the Act of local government.

MINUTES of the duly called ordinary meeting of The Hills Shire Council held in the Council Chambers on 26 July 2022. The press and the public are excluded from the proceedings of the closed council in respect of items 11 and 12 in accordance with the relevant clauses of section 10A, section 2 in the Local Government Act, 1993, as described in the table below.

The minutes of the above Meeting were confirmed at the Council meeting held on 9 August 2022.

ACCELERATED INFRASTRUCTURE FUND - REALLOCATION OF REMAINING ROUND 1 FUNDS (FP53)

This prompted an approach to potentially reallocating the remaining AIF Round 1 funds held by the Council. Accordingly, the reallocation of AIS Round 1 funds in the manner proposed would be consistent with current income projections and would simply be a work in progress.

LTC RECOMMENDATIONS JULY 2022 - SPURWAY DRIVE, NORWEST – PROPOSED WORKS ZONE

As part of Council's 'Connecting Centers Partnership Programme', a pedestrian shelter and associated parking restrictions were recently installed on Spurway Drive just to the south-west of the site. An application for a temporary 18 meter section of "Work Zone 7.00-17.00 Monday-Saturday" on Spurway Drive has been received by Growthbuilt Pty Ltd, which has an approval to build a residential dwelling at no. Spurway Drive has unrestricted parking, the applicant has requested 'Work Zone' restrictions near their driveway on Spurway Drive to facilitate deliveries and construction related activities on this site.

The developer must pay weekly fees for "work zones" on public roads and use of the nature strip area on Spurway Drive. The Committee supports the establishment of 18 meters of temporary restrictions for the '7am to 5pm Monday to Saturday Work Zone' on Spurway Drive, Norwest, as detailed in Schedule 1, for a period of 65 weeks. The Director General is given the power to approve any future request to extend to a 'work zone' up to a maximum of three months after the initial 65 weeks.

The following road closures are in effect for the street parade from 10:45 a.m. to 12:15 p.m. for the street parade. In the event of a closure of Blue Gum Road due to flooding, the Kenthurst Street Parade will be cancelled. VMS signs will be posted prior to the event to inform motorists of road closures for the Street Parade.

The Kenthurst Street Parade is an iconic event well attended by the local community. The road closures would be well supported by Kenthurst residents to allow for the Street Parade. Transport for NSW - 'Please also note that the TMP Collaboration of the 2022 Kenthurst Fair and Street Parade is currently being circulated for signature.

LTC RECOMMENDATIONS JULY 2022 - BRAMPTON DRIVE BEAUMONT HILLS – PROPOSED CHANGES TO EXISTING BUS

In the split bays outside no. There are two permanent "bus zones" at 28-32 and 21-25 Brampton Drive. The council received correspondence from a resident for full-time "bus zones" in subdivided bays outside no. 21-25 and 28-32 Brampton Drive, which are to be turned into part-time "bus zones" as they are only used for school services instead of route services.

It is therefore proposed to replace each of the existing full-time 'Buszones' with time-limited ones. This would prevent vehicles from parking within the length of the 'Bus Zone' on the school buses, while still allowing on-street parking outside of the designated times and days. The Committee supports the amendment of existing full-time restrictions in the 'Bus Zone' in Brampton Drive, Beaumont Hills, as detailed in Appendix 1 to the report.

LTC RECOMMENDATION JULY 2022 - GIRRALONG AVENUE, BAULKHAM HILLS – PROPOSED PARKING RESTRICTIONS

The 'Kiss and Drop' parental pick up and drop off zone is located in a bay on Girralong Avenue in front of the school. Kiss and Drop bay in front of the school on the north side of Girralong Avenue between the marked pedestrian crossing and the staff car park ramp and No Stopping am and pm schooldays restrictions from the end of the Kiss and Drop bay to the intersection of Henry Street (Figure 1). At the same time, vehicles are also parked along the south side of Girralong Avenue between Henry Street and the marked pedestrian crossing.

The section of Girralong Avenue between Henry Street and the start of the no parking area (Kiss and Drop Bay) is only 7 meters wide. When vehicles park on the south side of Girralong Avenue on this stretch of road and parents are also queuing for the “Kiss and Drop” bay, the road can become blocked. A consultation was held with affected residents on Girralong Avenue and no objections were received regarding parking restrictions on the north or south sides of Girralong Avenue.

LTC RECOMMENDATION FOR JULY 2022 - DAVEY ROAD, DURAL – PROPOSED ‘GIVE WAY’ SIGN AND LINEMARKING

Davey Road/Langford Road, Dural is a 1.9km long single carriageway rural road which provides a link between Wyoming Road and Derriwong Road. Residents report that vehicles at the intersection of Davey Road do not always give way to vehicles coming from Lancewood Road even though it is a T-intersection. In order to improve the safety and delineation of the intersection and ensure compliance with the Australian Standard, it is recommended that a 'Give way' sign with associated line marking be provided on Davey Road at the intersection of Derriwong and Lancewood Roads (Figure 3 ). ).

The installation of a 'Give Way' sign with associated line marking at the junction of Davey Road, Derriwong Road and Lancewood Road, Dural be approved in accordance with Figure 3 in the report. Mayor – “Most traffic travels along Davey Road and Derriwong Road, with very few cars traveling on Lancewood Road. At this stage, police and TfNSW representatives support the recommendation to install the Give Way control on Davey Road.

REWARD FOR INFORMATION POLICY

A policy that provides a reward for information leading to the conviction of illegal and anti-social behavior on or in our assets acts as both an incentive and a deterrent. The Council first adopted an Information Policy Award in 2011 to reduce incidents of vandalism and malicious damage to Council infrastructure assets by encouraging the community to monitor and report such incidents. Some councils, other than The Hills, were found to have accepted information policy awards.

In the case of NSW Police and Victorian Police, rewards are offered up to $1M depending on the scale/seriousness of the crime, whereas ACT Crimestoppers and other councils, the reward offered is typically $1K. There has been no uptake of the policy since its introduction and it is of course open to the Council to choose to delete the policy. It is recommended that the Council put the policy on display for 28 days and, should no negative comments be received, adopt the information reward policy.

This report recommends that Council purchase part of Lot 13 DP 1238414 (being part of 64 Tablelands Street, Box Hill) for the purpose of widening a local road for a sum of Council agrees to purchase part of Lot 13 in DP 1238414 at (being part of 64 Tablelands Street, Box Hill) for an amount exclusive of VAT (subject to final plan and review) and disturbance charges as described in this report with a contract amounting to Sale and all required deeds, plans, instruments, conveyances and all other related documents required shall be authorized to be executed under seal. The Council has entered into negotiations to acquire part of Lot 13 in DP 1238414 (being part of 64 Tablelands Street, Box Hill).

On this basis, Hill PDA recommended a market value of GST exclusive, plus payment of the seller's reasonable disruption costs. On May 4, 2022, a "No Prejudice" offer was made to the landowners to exclude GST, plus payment of the seller's reasonable nuisance charges. announce that the Council has approved the purchase of Sublot 13 at DP 1238414 at 64 Tablelands Street, Box Hill.

To amend the existing easement it is necessary to document lot 14 DP 227212 as a receiving lot in the 88B instrument. Council agrees to amend the existing easement to include lot 14 DP 227212 as a beneficiary to the existing easement with compensation of excl. GST plus all costs associated with the creation and registration of the change to be paid by the applicant.

The redevelopment of the Waves Fitness & Aquatic Center located on the AH Whaling Memorial Reserve necessitates registration of title, restrictions/positive covenants for water sensitive urban design (WSUD) elements and on-site Stormwater Detention (OSD) systems. It is proposed that a positive covenant in favor of the Council of the Shire of Baulkham Hills*. The terms of the positive covenant encumbered with Lot 2000 DP 1261746 to be created are detailed below.

This agreement is binding on all persons claiming to be registered owners as defined in section 88D(8) of the Act. The conditions of the restriction on the use of land encumbered on parcel 2000 DP 1261746 which is proposed to be created are detailed below. The Registered Owner shall not implement or permit or suffer any changes to the storm water treatment measures/water sensitive urban design elements that are or will be constructed on the burdened plots without the prior written consent of The Hills Shire Council.
