SUMMARY OF PLANNING PROPOSAL, DRAFT DCP AND DRAFT VPA

In support of the planning proposal, a new section of the Hillside Development Control Plan (DCP) 2012 (Part D, Section 23 – Norwest Station Location) was prepared and publicly exhibited at the same time as the planning proposal. The draft control covers key matters relating to future character, site layout, land use, building height, setbacks, active frontages, public domain, solar access, lighting, sustainable design, wind and parking. The draft Voluntary Partnership Agreement would provide development contributions in connection with the future development of the city to the value of 3% of the development costs.

This would include a 2.5% cash contribution (worth approximately $5 million) as well as a 0.5% value associated with local infrastructure works being the plaza (beautification only) and selected local traffic work on Brookhollow Avenue ( involving the relocation of the existing pedestrian crossing and berm to align with the plaza and removal of the existing berm on the island and replacement with new curb and paving).

GATEWAY DETERMINATION

Each public authority/body must be given a copy of the planning proposal and any relevant supporting material and given at least 21 days to comment on the proposal. A public hearing is not required to be held on this matter by any person or body under section 3.34(2)(e) of the Law. The deadline for completion of the LEP must be 18 months after the Gateway designation date.

All relevant transition designation requirements (as amended) have been met. The council was not authorized as a local body to draw up the plans because the ministry considers the area to be a national priority.

EXHIBITION DETAILS

Compliance with Section 45 of the SEPP will be required as part of any future development application on the site. It is recognized that the rise proposed at this site (and more broadly throughout the Norwest Strategic Center) may require the extension of the existing power grid. Significant analysis was carried out as part of the initial assessment of the proposal to arrive at the proposed car parking rates in the draft DCP.

This is also consistent with the findings of the Proponent's Traffic and Transport assessment submitted in support of the planning proposal. Potential heritage impacts associated with Bella Vista Farm have been adequately considered as part of the planning proposal. Preliminary analysis was undertaken as part of the initial assessment of the proposal to arrive at significantly reduced parking rates within the draft DCP.

This rate will significantly reduce the level of traffic generated by the future development.

Proposed closure of Council – Christmas/New Year

The council is accountable to the community and meets legislative requirements in an efficient and proactive manner. a) Operational Depots will close at 1pm on Friday 24 December 2021 and Emergency Response Teams will operate as detailed in Appendix 2 until Tuesday 4 January 2022. Proposed opening hours for the City Center for customer support is as follows:-. e) The days of closure for the five (5) childcare centers of the Council are as follows: - The center has reopened since the closure. As the Australian insurance market "hardens", the likelihood that we will be able to provide the most competitive insurance policies without being part of an insurance mutual arrangement is decreasing.

These risk management services are not available to the Council through its current insurance arrangements; and, Insurance is a key mitigating process of the Council's risk management system and will support the effective management of insurance claims to the council and the efficient delivery of services to the community. CivicRisk Mutual Ltd (CivicRisk) ABN is a joint venture of 24 NSW councils established under section 358 of the Local Government Act to provide insurance and risk management solutions. CivicRisk Mutual has a strong 30-year track record of delivering risk management and insurance solutions to protect its local government members. Our Continuous Risk Improvement Program (CRIP) assesses members' risk maturity and provides a risk management benchmark.

Every two months the board's risk managers meet to focus on claims and risk management issues. Training and workshop sessions support the members' risk management program and provide opportunities for professional development. CMA attends the Risk Management Committee bi-monthly to discuss and agree claims.

The CMA and Risk Management Committee liaise with insurance brokers to ensure there are no gaps in insurance coverage. Each member is required to commit to an Enterprise Risk Management (ERM) philosophy and participate in mutually funded projects. CivicRisk Mutual assists Council to implement a risk management framework in line with Australian and international standards.

An annual awards program recognizes members' efforts and highlights areas of risk management excellence.

This report recommends that Council approve the compulsory acquisition of Premises 5 DP 1227656, Withers Road, North Kellyville for road widening and that an application be sent to the Minister and the Governor for approval for compulsory acquisition of the subject land. Construction of the Withers Road upgrade is proposed in the FY 24/25 Capital Works program, but could be brought forward if design, approvals and land acquisition match. As part of the Withers Road upgrade, the acquisition of the land zoned SP2 infrastructure is required to ensure that the land will be in the Council's possession prior to the commencement of the Works programme.

Negotiations started in July 2017 for the acquisition of the relevant land with the representative of the landowner, on behalf of the owners at their request to the municipality to acquire the property. This further assessment took extra account of the adverse effects that would be created for the adjacent landowners in connection with the height and impact of the elevated bridge crossing and dikes, and provided the Council with a revised view. On September 6, 2021, the council was approached by the landowner's representative to say that he will receive an appraisal to assess the market value of the property.

Since no agreement has been reached on the amount of land purchase compensation required for road widening, it is considered a quick way to finalize the matter by commencing expropriation. Request to the Minister to ask permission for the forced acquisition of the land with documents showing the status of the negotiations (6 to 8 weeks for response). If the claimant accepts the amount of damages offered, payment of the damages must be made within 28 days after the Board has received the claim for damages, together with a deed of indemnity and release (Acceptance Section 44 Form).

Council is proceeding with the compulsory acquisition of Lot 5 in Deposited Plan 1227656, Withers Road, North Kellyville in accordance with the requirements of the Just Terms Compensation Act 1991. Council is submitting the necessary application to the Minister for Local Government under Section 177 of the Paie Act (NSW) 1993 to obtain approval from the Governor in terms of Section 19 of the Land Acquisition (Just Terms Compensation) Act 1991 for the publication of an Acquisition Notice in the NSW Gazette. A Deed of Release and Request document notifying the Registrar General of the proposed acquisitions is authorized for execution under Seal.

While we hope that negotiated acquisitions can be achieved, it seems prudent to begin the preliminary steps for a compulsory acquisition to avoid further undue delays in completing acquisitions in the future. There is $33,617 available in CP13 to purchase this property but the final cost of the acquisition is unknown as the Valuer-General will need to assess compensation for the land under the Land Acquisition (Compensation on Equitable Terms) Act 1991 if compulsory acquisition is approved .
