PLANNING PROPOSAL UPDATE

The planning proposal must demonstrate the strategic advantages before the advantages of the individual area are considered in more detail. As such, the Commission recommended that the planning proposal not proceed after the transition was determined.

REVISED PLANNING PROPOSAL AND ADDITIONAL INFORMATION

The planning proposal is of low scale and forms a logical extension of the existing village of the Dural neighbourhood. The approximate location of the land affected by the planning proposal is shown in yellow.

Gateway Determination

INTRODUCTION

This is discussed in this report as part of the strategic assessment of the proposal in terms of the District Plan. The Council decided (Attachment A2) that the proposal should be submitted to the Department for Gateway Assessment to determine the views of the State Government Agency on the merits of the proposal. March 11, 2020 The proponent provided unsolicited additional information (Attachment G) detailing the public benefit of the proposed drop-off zone on the operation of the surrounding road network.

PROPOSAL

This is because the site in isolation cannot adequately ensure the scale of improvement required in the road network; and. The proposal includes the reservation and delivery of a section of the road that bypasses Rondehoek from Annangrove Road to Old Northern Road and New Line Road (Round Corner Bypass). To ensure development does not place an unreasonable burden on the provision of services, facilities and infrastructure in the area to which this clause applies.

NEED FOR THE PLANNING PROPOSAL

STRATEGIC ASSESSMENT 1 District

The planning proposal is inconsistent with this local strategy as it seeks to enable urban development in an area identified as rural in the Council's Countryside Strategy. Non-Compliant: The planning proposal does not comply with the following Ministerial Guidance Section 9.1 as explained below. This is inconsistent with this guidance as the planning proposal seeks to rezone the land from RU6 transition to R2 low density housing.

SITE-SPECIFIC ASSESSMENT 1 Social

The reason for this is that the isolated location cannot sufficiently guarantee the required scale of improvement in the road network. The planning proposal does not demonstrate sufficient site-specific merits to provide the required funding and upgrades to road infrastructure needs in the greater area.

RECOMMENDATION

The Commission took note of the history of the site and its location in the metropolitan rural area, and also expressed its views on the site-specific merit of the proposal. I understand that the petitioner believes it can meet the requirements of the district plan, as well as respond to the Department's concerns about the potential for regional traffic generation. A copy of the final wording of the clause is attached as Appendix 1 to this report.

Optional Natural Disasters Clause

ORDINARY MEETING OF THE COUNCIL 09 FEBRUARY 2021. the EP&A Act), they may deny the application based on its merits (particularly with regard to potential risks and environmental impacts). Therefore, should the Council decide to apply this new clause, it is recommended that it be applied to the above-mentioned areas, as they are likely to be most at risk of natural disasters. Within the above zones, it is estimated that there are approximately 61,900 properties that will fall under the new clause in the event that a natural disaster damages or destroys a residence or second home.

Potential for Unintended Impacts

Following receipt of this letter, a number of phone calls and emails were received from property owners objecting to the construction of the concrete path. The objections to the construction of the concrete path are acknowledged, especially the objections received from property owners who are directly affected by the project. A further submission in support of the project was also received from a property owner on the opposite side of Ellerslie Drive.

Information provided by the NSW Cladding Taskforce shows LGA Hills has one of the highest numbers of buildings with combustible external cladding. The Council has been waiting for the reforms of the ZGL, however its delay now offers the opportunity to consider changes in the functioning of its audit committee. Other non-voting members participate with the approval of the audit committee through its Chairman.

Additional meetings will be convened at the discretion of the Chairman or at the written request of any member of the Committee, internal or external auditor, and the General Manager. All matters to be dealt with arising from the proceedings of previous meetings of the committee, and. ii) Any matter or topic that the Chairman proposes at the time the agenda is prepared to be placed at the meetings, and. iii) All matters, including matters subject to staff reports to the committee. In both cases, the meeting must be adjourned to a time, date and place determined by the Chairman, or in his or her absence, by the majority of the members present.

Duties and responsibilities

All requests for disclosure of information relating to the Committee will be dealt with by the Council's Public Officer subject to the Government Information (Public Access) Act 2009 and the Privacy and Personal Data Protection Act 1998. Review any significant changes that may arise following such a recommendation , but before signing the financial report. xi) Discuss significant issues arising from the annual external audit with the external auditor. xii) Identify, refer and request special projects or investigations deemed necessary through the Council or the CEO as appropriate. Supervise all follow-up investigations (where appropriate), including overseeing investigations of all suspected cases of fraud within the organization. xiii) Dealing with matters brought to the Committee's attention, including responding to Council requests for advice that are within the parameters of the Committee's mandate.

Review of the Charter

The LRCI program is part of the government's $1.8 billion boost to road and community projects by local governments across Australia. Therefore, Appendix 5 contains a list of potential 'Reserve' projects that can be bought into the LRCI Phase 2 expansion program subject to the approval of the Department of Infrastructure, Transport, Regional Development and Communications. Acceptance of the LRCI Phase 2 Expansion Program grant will have no direct financial impact on the Council.

Local Roads and Community Infrastructure Program Process

The grant opportunity set out in these guidelines is for Phase 2 of the LRCI program only. The LRCI program supports local councils to create jobs by delivering priority local road and community infrastructure projects across Australia.

About the LRCI Program – Phase 2

The Department will administer the LRCI program in accordance with the Commonwealth Grants Rules and Guidelines 2017 (CGRGs).

What the grant money can be used for

Proof of maintenance of capital expenditure will be a requirement for the eligible funding recipient to receive the full Phase 2 allocation. Eligible grantees may propose later phases of projects already receiving funding under the LRCI program, provided that the component funded under Phase 1 is not modified without the approval of the Ministry and maintains its eligibility in accordance with the relevant program guidelines. Eligible grantees cannot use grant money to pay for normal activities and expenses or other activities and expenses unrelated to eligible projects.

The grant selection process

As construction must be completed by December 31, 2021, after July 31, 2021 the Department expects to administer only variations or additional project nominations to ensure that an eligible grantee is able to fully utilize their Phase 2 award.

Notification of outcomes

Successful grantees

The value of the first installment is 50 percent of an eligible funding recipient's Phase 2 allocation. Eligible funding recipients will be notified in writing of the decision to release a progression term. The last installment is the lesser of the remaining amount of a qualifying loan.

Announcement of grants

The final installment will be paid within four weeks of the delegate's decision to release the grant payment. In accordance with the terms of the Australian Taxation Office ruling GSTR 2012/2, payments made under the LRCI program are payments made by a government-related entity to another government-related entity and for which the grant amount does not exceed the cost of supplying the goods or the services do not attract VAT. As a result, the actual and expected expenditure that Eligible Funders report to the Department must exclude the GST component on goods and services, and the payments made by the Institute to Eligible Funders to cover the costs of the program will not include GST.

Reporting requirements

Eligible grant recipients must provide the institute with an annual report no later than 14 February 2022, unless otherwise agreed by the institute. The department may also inspect the records that eligible grantees are required to maintain under the grant agreement.

How we monitor your grant activity

Eligible funding recipients must comply with all relevant laws and regulations when undertaking Eligible Projects on an Approved Work Schedule. The Eligible Funding Recipient must provide details of the proposed ceremony or event, including proposed invitees and order of proceedings. If requested by the Department or the relevant local federal Member of Parliament, Eligible Funding Recipients must organize a joint Australian Government/Eligible Funding Recipient works commencement ceremony, opening ceremony or any other event.

Probity

If a recipient of eligible funding subsequently identifies an actual, apparent, or perceived conflict of interest, they must immediately notify the Department in writing. ORDINARY COUNCIL MEETING 09 FEBRUARY 2021 The Australian Government may also use and disclose information about eligible funding. Eligible Funding Recipients must therefore not do anything which, if done by the Department, would breach an Australian Privacy Principle as set out in the Act.

Consultation

All documents held by the Australian Government, including those relating to this grant opportunity, are subject to the Freedom of Information Act 1982 (FOI Act). The purpose of the FOI Act is to give members of the public the right of access to information held by the Australian Government and its entities. Under the FOI Act, members of the public can seek access to documents held by the Australian Government.

Glossary

Information or an opinion about an identified person, or a person who is reasonably identifiable; Approved Work Schedule The work schedule that outlines the eligible projects for which the eligible funding recipient can use grant money. Work Schedule A list of projects that an eligible funding recipient proposes to fund under the LRCI program.
