Penelitian ini bersifat deskriptif yaitu penelitian yang bertujuan untuk menggambarkan secara umum tentang status dan kondisi dari Pelaksanaan Perjanjian Bagi Hasil atas Tanah Pertanian pada masyarakat khususnya di Kecamatan Sipoholon, Kabupaten Tapanuli Utara

Data yang terkumpul dianalisis dengan metode pendekatan yuridis sosiologis, dimana pendekatan terhadap permasalahan dengan meneliti kenyataan (fakta empiric) dengan ketentuan-ketentuan dalam peraturan perundang-undangan, teori, hasil-hasil penelitian dan laporan-laporan yang berhubungan dengan objek yang diteliti.

serta langkah langkah penertiban dari instansi terkait sebagaimana diperintahkan oleh Undang-undang.

Saran yang diajukan dalam penelitian ini yaitu: 1) Undang-undang nomor 2 tahun 1960 merupakan salah satu produk hukum positif di Indonesia, namun dari beberapa hasil penelitian dinyatakan bahwa undang-undang tidak berjalan efektif di masyarakat, sehingga sudah perlu di evaluasi atau ditinjau kembali pemberlakuannya agar sesuai dengan kebutuhan masyarakat. 2) perlunya peran aktif dari instansi terkait dalam hal ini pihak Pemerintah Daerah maupun dari Pihak Kanwil Departemen Kehakiman dan HAM setempat untuk melakukan sosialisasi juga penyuluhan hukum dengan maksimal atas setiap peraturan perundang-undangan yang bersentuhan langsung dengan mas; arakat pertanian khususnya,untuk keefektifan pemberlakuan Undang-undang Bagi Hasil di Kabupaten Tapanuli Utara Khususnya, 3) perlu adanya penelitian lanjutan yang lebih menyeluruh.

This research is descriptive, that is, the research which is aimed to describe generally the status and condition of the implementation of the agreement of sharecropping on farmland in the society of Sipoholon Sub district, North Tapanuli Regency.

The data collected were analyzed using the method of juridical, sociological approach, and by the approach on the problem, the empirical facts were observed using the provisions in the regulations, theory, the results of the research, and the reports related to the observed objects.

T h i s r e s e a r c h d r a w s t h e c o n c l u s i o n s , t h a t : 1 ) t h e a g r e e m e n t o f t h e sharecropping has been known by the society of Sipoholon Sub district, North Tapanuli Regency, which is implemented based on the existing tradition in the society, it is because the system of kinship in the society is still close, the parties have familial relationship, the land cultivation using sharecropping system which is aimed to help the economy of the cultivators and their families and in order that the land does not become wasteland. 2) In general, the characteristics of the agreement of sharecropping on farmland in the society of Sipoholon Sub district, North Tapanuli Regency are the one which is made orally or unwritten, the agreement is not in the presence of the witnesses, the sharecropping is on 1/3 - 2/3 basis, 1/3 is for the landowner and 2/3 is for the cultivator bears all the production costs and labor, the duration is not determined, the basis of the agreement is kinship, convention, an mutual trust between the parties, the objects of sharecropping are not only crops but also hard plants, there is not any indications of blackmail on the cultivator. 3). The inhibiting factor of the implementation of the Act No.2 of 1960 at Sipoholon Sub district, North Tapanuli Regency is that the Act of Sharecropping at the location of the research has not been socialized, moreover all the Sub district and in the regency do not know the existence of the Act of Sharecropping, initially, the society think that it is sufficient that they have the rules of sharecropping in the form of convention in the society, there is not any socialization and supervision or the measurements of control from the relevant instances as instructed by the Act.

The suggestions of this research are as follows: 1) The Act no.2 of 1960 is one the product of positive law in Indonesia, however, from some results of the research, it is stated that the Act is not implemented effectively in the society, so that it is necessary needs of the society. 2) The requirement of active role of the relevant instances, in this case, the district government and the local Regional Office of the Department of Justice an Human Rights to make a socialization and legal extension e l u c i d a t i o n m a x i m a l l y o n t h e r e g u l a t i o n s r e l a t e d d i r e c t l y t o a g r i c u l t u r a l o f sharecropping in North Tapanuli Regency specially, 3). The need of further whole research.
