A G R E E M E N T

BETWEEN THE GOVERNMENT

OF THE

REPUBLIC OF INDONESIA

AND

THE COMMISSION OF THE EUROPEAN COMMUNITIES

ON

THE ESTABLISHMENT AND THE PRIVILEGES AND IMMUNITIES

OF THE OFFICE IN JAKARTA

OF THE COMMISSION OF THE EUROPEAN COMMUNITIES

With a view to further strengthening the friendly relations between the

European Communities and the Republic of Indonesia, the Commission of the

European Communities has decided on and the Republic of Indonesia has

agreed to the establishment in Jakarta of an office of the Commission of

the European Communities.

The Office of the Commission of the European Communities will be under

the responsibility of the Head of its Delegation for South-East Asia.

The Commission of the European Communities and the Government of the

Republic of Indonesia have agreed on the following measures to implement

this decision :

Article 1

1. The European Communities represented through its Commission shall

have legal personality, within the territories of the Republic of Indonesia.

2. The Communities shall have the capacity to conclude contracts, to

acquire and dispose of immovable property and to conduct legal proceedings,

and shall be represented for that purpose by the Commission on the

territory of Indonesia.

-Republic of Indonesia within its territories the same privileges and

immunities as those which in conformity with the Vienna Convention on

Diplomatic Relations of 18th April 1961 are granted to diplomatic missions

accredited to the Republic of Indonesia provided that, in accordance with

Article 17 of the Protocol of the privileges and immunities of the European

Communities annexed to the Treaty establishing a single Council and a

single Commission of the European Communities done at Brussels on

8 April 1965, the Member States of the European Communities accord the

same privileges and immunities to the Mission of Indonesia to the European

Communities, to its head and members and to the members of their families

comprising their household.

2. The privileges and immunities referred to in paragraph 1 shall not be

accorded to persons having Indonesian nationality or permanent residence

in Indonesia that are employed at the Office in Jakarta of the Commission

of the European Communities.

Article 3

This Agreement shall enter into force after the contracting parties have

informed each other through diplomatic channels, of the approval of the

Agreement by their competent authorities in accordance with their

respective provisions.

In witness whereof, the undersigned, duly authorised to this end, have

signed this Agreement.

Communities, to its head and members and to the members of their families comprising their households.

2. The privileges and immunities referred to in paragraph 1 shall not be acco rded to persons having Indonesian nationality or permanent residence in Indonesia that are employed at the Office in Jakarta of the Commission of the European Communities.

Article 3

This Agreement shall enter into force after the contracting parties have informed each other through diplomatic channels, of the approval of the Agreement by their competent authorities in accordance with their

respective provisions.

In witness whereof, the undersigned, duly authorised to this end, have signed this Agreement.
