ABSTRAK
Penanaman modal asing merupakan salah satu kegiatan yang mengalami perkembangan pada masa globalisasi ekonomi saat ini. Banyak negara berlomba-lomba agar dapat menarik investor asing untuk menanamkan modalnya di negaranya. Salah satu upaya yang dilakukan adalah dengan merumuskan Bilateral Investment Treaty antara Indonesia dengan Belanda (BIT Indonesia – Belanda) sebagai bentuk perjanjian bilateral yang mengatur masalah perlindungan terhadap investasi asing. Salah satu standar perlindungan yang diberikan oleh BIT adalah mengenai survival clause. Survival clause diperlukan apabila para pihak menghendaki seluruh pasal dalam perjanjian tersebut akan tetap berlaku pasca perjanjian tersebut berakhir dalam jangka waktu yang disepakati para pihak. Tujuan dari penelitian ini adalah untuk memahami perlindungan hukum bagi investor Belanda dan pelaksanaan penerapan
survival clause pasca berakhirnya BIT Indonesia – Belanda.
Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif. Pendekatan ini dilakukan dengan cara menguji dan mengkaji data sekunder berupa hukum positif, asas-asas hukum, serta kaidah-kaidah hukum yang berhubungan dengan hukum penanaman modal.

ABSTRACT
Foreign investment is one of the activities that has been developed during this time of econimic globalization. Many countries are competing to attract foreign investors to invest in their countries. One of the efforts is to formulate the Bilateral Investment Treaty between Indonesia and the
Netherlands (Indonesia – Netherlands BIT) as a form of bilateral
agreement providing the protection of foreign investment. One of the protection standard provided by the BIT is about survival clause. As it can be seen in the BIT, the survival clause alludes that even if the agreement terminated, the articles of the agreement will be remained effective for a period of time that agreed by the parties. The purpose of this research is
to understand legal protection for Netherlands’ investor and the
implementation of survival clause after the termination of Indonesia –
Netherlands BIT.
The approach that being used in this research is normative juridical. This approach is in use by means of testing and reviewing secondary data in the form of positive law, general principles of law, and the rules of law relating to the investment law.
Based on the results, it can be concluded that the Netherlands’
Investor have the survival clause protection from Indonesia – Netherlands
