ON-THE-JOB TRAINING PROGRAM

TRAINING AGREEMENT

(Amongst Participating Educational Institution, Partner Establishment, Trainee and Parent/Guardian)

This AGREEMENT duly entered into this of 2017, by and amongst the following:

The COLLEGE OF TECHNOLOGICAL SCIENCES-CEBU with business address at N. Bacalso Avenue, Sambag 1, Cebu City, hereinafter referred to as the FIRST PARTY;

- and –

The KEN TANSPORTATION INC with business address at LINAO MINGLANILLA CEBU hereinafter referred to as the SECOND PARTY;

- and -

The following student-trainee hereinafter referred to as the THIRD PARTY:

JONATHAN DELOS SANTOS, Filipino, of legal age, and a resident of Cebu City.

WITNESSETH: That the FIRST PARTY and the SECOND PARTY together with the THIRD PARTY, do hereby agree and bind themselves as follows:

1. That the FIRST PARTY and the SECOND PARTY shall coordinate their efforts to develop the skills, knowledge and attitude of the THIRD PARTY through the implementation of SHS Work Immersion program.

2. That the FIRST PARTY shall provide the THIRD PARTY the needed occupation-related theoretical instructions of the SHS Work Immersion Program .

3. That the SECOND PARTY shall equip the THIRD PARTY the necessary practical or hands-on training of the dual training program inside the work premises of the training duration.

That the THIRD PARTY agrees to cooperate with both the FIRST and SECOND PARTIES for the purpose of acquiring and developing job qualifications for _________________________________.

4. No employer-employee relationship shall exist between the FIRST PARTY and the SECOND PARTY at the time of the engagement of the THIRD PARTY for OJT Program.

6. During the engagement of the THIRD PARTY for SHS Work Immersion Program , the THIRD PARTY shall abide the company policies of the SECOND PARTY and any violation thereof shall be a ground for removal of THIRD PARTY from the said program.

7. That the THIRD PARTY agree to attend diligently and faithfully in the in-school and in-plant portion of the training during the period of the SHS Work Immersion Program and under the following terms and conditions:

Total Training duration : 400 HOURS

Date of start of training : _______________

Approximate date of completion : ________________

8. That the THIRD PARTY shall attend in-plant training within the operations of the SECOND PARTY equivalent to eight (8) hours per day minimum. That in some instances, the THIRD PARTY may be required by the SECOND PARTY to report for training other than the regular working schedules of the SECOND PARTY, when needed and subject to approval by the FIRST PARTY.

Overtime may be allowed provided the hours of overtime rendered are duly credited towards hour of training with the effect of shortening the period of in-plant training.

9. That a Monthly Progress Report shall be maintained by the THIRD PARTY, wherein he/she will record his/her daily attendance and accomplishment for the day during the in-plant training. This same logbook shall be submitted to the FIRST PARTY through the office of the Industry Linkage Development Office for inspection and recording of training hours accumulated.

10. That the SECOND PARTY, through its assigned Work Immersion Teacher, shall monitor and inspect the trainee’s logbook for entry of daily activities and accomplishment and confirm entry by signing in the space provided for.

11. That the THIRD PARTY may be allowed to go on leave in between school terms to allow the THIRD PARTY to take rest from in-school and/or in-plant training.

12. During the period of training, any party to this Agreement may terminate said Agreement by serving written notice for the other parties at least fifteen (15) working days before the actual date of termination, stating the reason thereof.

13. Any party to this Agreement may terminate the same only for the valid causes mentioned in the MOA. Problems that occurred shall be investigated first by the Industrial Coordinator and shall be reported to the concerned parties.

PARTY through the Evaluation and Appraisal Form and issue the necessary Certificate of Training of the Work Immersion Program.

15. The rules and regulations of the FIRST and SECOND PARTIES shall be observed as part of the terms and conditions of this Training Agreement.

16. This Agreement shall take effect on the date of the start of training by the THIRD PARTY.

In WITNESS WHEREOF, the parties have hereunto affixed their signature this __________ day of 2017 at Cebu City, Cebu, Philippines.
