DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 546/MPP/Kep/7/2002 DATED JULY 24, 2002
ON
THE FORMATION OF A TEAM OF ANTI-DUMPING DUTY OF IMPORTED WHEAT FLOUR
THE MINISTER OF INDUSTRY AND TRADE,
Considering :
a. that wheat flour is one of foodstuffs used widely in Indonesia by wheat flour-based downstream industry ad a raw material as well as by wheat flour end- users, so that their interests need to be protected;
b. that the supply of wheat flour to meet domestic needs can originate from domestic production and import; c. that wheat flour industry has grown in Indonesia that the survival of its activities needs to be maintained; d. that to that effect a team of anti-dumping duty on imported wheat flour needs to be formed.
In view of :
1. Law No. 7/1994 on the Ratification of Agreement Establishing the World Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute Book No. 3564);
2. Law. No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612); 3. Government Regulation No. 34/1996 on Anti- Dumping Duty and Countervailing Duty (Statute Book of
1996 No. 5, Supplement to Statute Book No. 3639);
4. Presidential Decree No. 17/2000 on the realization of the State Budget ;
5. Presidential Decree No. 228/M/2001 on the Formation of Mutual-Help Cabinet;
6. Presidential Decree No. 102/2001 on the Position, Task, Function, Authority, Organizational Structure and Work Mechanism of Ministry;
7. Presidential Decree No. 109/2001 on the Organizational Unit and First Echelon Officials of Ministry; 8. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the Organizational Structure and
Work Mechanism of the Ministry of Industry and Trade;
9. Decree of the Minister of Industry and Trade No. 153/MPP/Kep/5/2001 on the Compulsory Application of Wheat Flour as Foodstuff (SNI 01.3751-2000/Rev. 1995 and its revision).
DECIDES :
To stipulate :
FIRSTLY :
A Team for the Assessment of Anti-Dumping Duty on Imported Wheat Flour, hereinafter referred to as the Team for the Assessment of BMAD, shall be set up with its lineup attached thereto.
SECONDLY :
The Team for the Assessment of BMAD shall be assigned to :
1. Assess whether or not the imposition of anti-dumping duty on imported wheat flour needs to be linked to the existence of wheat flour industry, the development of wheat flour-based downstream industry and the interests of wheat flour end -users at home ;
THIRDLY :
To ensure that the Team for Assessment of BMAD carries out its tasks smoothly, a Technical Team of Anti-Dumping Duty (BMAD) shall be set up with its lineup attached thereto.
FOURTHLY :
The Technical Team of BMAD shall be assigned to :
1. Assist the Team for the Assessment of BMAD in assessing whether or not anti-dumping duty needs to be imposed by calculating the reasonable rate of anti-dumping duty on imported wheat flour in relation to the interests of wheat flour industry, the development of wheat flour-based downstream industry and the interests of wheat flour anti-dumping at home ;
2. Convey reports on the realization of its tasks as referred to in point to the Chief of the team for the Assessment of BMAD.
FIFTHLY :
The Chief of the Team for the Assessment of BMAD shall be responsible and be obliged to convey reports to the Minister of Industry and Trade.
SIXTHLY :
The tenure of the Team for the Assessment of BMAD shall be 2 (two) months starting from the stipulation date of this decree.
SEVENTHLY :
All expense arising from the implementation of this decree shall be borne by the budget of the Ministry of Industry and Trade.
EIGTHLY :
This decree shall come into force as from the date of stipulation.
