ABSTRAK
Asas cabotage membatasi lalu lintas domestik suatu negara untuk kapal-kapal berbendera nasional. Masalah timbul ketika kapal-kapal-kapal-kapal Indonesia yang digunakan dalam usaha hulu migas offshore tidak tersedia sehingga pasokan energi berpotensi terganggu. Padahal secara filosofis asas ini berperan sebagai penggerak ekonomi dan wujud aplikatif kedaulatan negara di laut. Penelitian ini bertujuan untuk menganalisa implikasi hukum diberlakukannya asas cabotage dalam UU Pelayaran terhadap kapal-kapal dan stakeholders terkait perkembangan operasi dan pengangkutan di sektor migas serta bagaimana peraturan pelaksanaan mengaturnya.
Penelitian dalam penulisan skripsi ini menggunakan metode pendekatan yuridis normatif dengan menitikberatkan pada penggunaan data sekunder dan bahan pustaka, baik berupa peraturan dasar, peraturan perundang-undangan, asas-asas hukum dan pengertian-pengertian hukum. Spesifikasi penelitian ini bersifat deskriptif analitis, yaitu dengan cara menghimpun, mengolah dan menganalisis ketentuan-ketentuan, kenyataan dan teori-teori hukum yang berlaku terhadap objek penelitian. Penulis melakukan pengumpulan data melalui studi kepustakaan dan studi lapangan.

ABSTRACT
The cabotage principle reserves the domestic shipping route of a state for its national flagged vessels. Complications arise from the absence of Indonesian flagged vessels needed for offshore exploration and exploitation operations in the upstream oil and gas sector, potentially endangering the energy supply; whereas philosophically, cabotage in virtue lies within its intention to uphold the economy and state sovereignty at sea. This study aims to analyze the legal implications resulting from the cabotage principle in the Indonesian Shipping Law Act against vessels and stakeholders involved in the development of operations and shipping arrangements in the oil and gas sector and how the Act’s technical regulations follow.
The study methodology emphasizes basic legal grounds, positive law, legal principles and definitions, known as the judicial normatives method. The descriptive analytical analysis is used in particular through elaborating regulations, legal reality and its theories towards the object of this study. Furthermore, data collection was gained through literature and on site research.
