THE APPOINTMENT OF THE EXECUTING AGENCY FOR MONITORING INTERNATIONAL TRADE AND INDUSTRIAN DEVELOPMENT

THE MINISTER OF INDUSTRY AND TRADE
Considering :
a. that in the framework of anticipating the tighter competition in the current globalization era, the fast, on time and accurate provision of data is needed to make policies on international trade and industrial development;
b. that in order to facilitate and smooth business entities in undertaking export activities, it is necessary to develop the automatic issuance of documents accompanying exported goods;
c. that since PT. Sucofindo ad the monitoring agency for export quotas of Textile and Clothing (TPT) has already succeeded in monitoring TPT subjected to the quota system, the company is deemed capable of monitoring the international trade and industrial development;
d. that in view of the fact that the appointment of PT Sucofindo limited-liability company (Persero) as the executing agency for exports is still limited to TPT quotas, it is necessary to be continued and increased by assigning broader tasks so as to be able handle the monitoring of international trade and industrial development;
e. that in connection with the above matters, the Decree of the Minister of Industry and Trade No. 12/MPP.SK.I/1996 on the appointment of the executing agency for exports of TPT subjected to the quota system needs to be reviewed;
f. that it is therefore necessary to stipulate a decree of the Minister of Industry and Trade; In view of :
1. Presidential Decree No. 260/1967 on the affirmation of tasks and responsibility of the Minister of Trade in the field international trade;
2. Presidential Decree No. 44/1974 on principles of organizations of ministries;
3. Presidential Decree No. 16/1994 on the implementation of the state budget of revenue and expenditure as already amended several times the latest by Presidential Decree No. 6/1999;
4. Presidential Decree No. 61/1998 on the status, tasks, organizational structures and working arrangements of ministries ad already amended several times the latest by Presidential Decree No. 142/1998;
5. Presidential Decree No. 122/M/1998 on the establishment of the development reforms cabinet; 6. Decree of the Minister of Industry and Trade No. 255/KP/X/1995 on the release of goods to foreign
countries outside the general provisions in the field of export as already amended several times the latest by the Decree of the Minister of Industry No. 317/MPP/Kep/9/1997;
7. Decree of the Minister of Industry and Trade No. 130/MPP/Kep/6/1996 on certificates of origin of Indonesian exported goods as already amended by the Decree of the Minister of Industry and Trade No. 101/MPP/Kep/2/1998;
8. Decree of the Minister of Industry and Trade No. 374/MPP/Kep/8/1998 concerning the provisions on ex port quotas and clothing;
9. Decree of the Minister of Industry and Trade No. 444/MPP/Kep/11/1998 jo. No. 24/MPP/Kep/1/1999 on the organization and working arrangement of the Ministry of Industry and Trade;
10. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on the general provisions in the field of export as already amended by the Decree of the Minister of Industry and Trade No. 146/MPP/Kep/4/1999;

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE APPOINTMENT OF THE EXECUTING AGENCY FOR MONITORING INTERNATIONAL TRADE AND INDUSTRIAL DEVELOPMENT
Article 1
To appoint PT Sucofindo limited-liability company (Persero) to monitor international trade and industrial development.
Article 2
The realization of the monitoring as meant in Article 1 shall include :
a. the monitoring of exports of Textile and Clothing (THT) subjected to quota and non-quota systems; b. the implementation of automatic issuance of documents of certificates of origin of Indonesian
exported goods as meant in the Decree of the Minister of Industry and Trade No. 130/MPP/Kep/6/1996 jo. No. 101/MPP/Kep/2/1998;
c. the monitoring of exports of non- TPT products; d. the monitoring of imports; and
e. the verification of capacities of industries.
Article 3
(1) The execution of the respective activities as meant in Article 2 shall be contained in a working agreement between the Ministry of Industry and Trade and PT Sucofindo (Persero)
(2) The working agreement as meant in paragraph (1) shall be signed by the Director General of International Trade for and on behalf of the Minister of Industry and Trade.
Article 4
Costs required for implementing the activities as meant in Article 3 shall be borne by the budget of the Ministry of Industry and Trade.
Article 5
This decree shall come into force as from the date of stipulation.
For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
