A. The University should implement the review made by OCPC of the University'splantiUa of personnel for the purpose of adjust- ing all salaries to the 'prescribed rates' (of annual salaries) in 'The Salary Schedule' provided for in P.O. 985, except that the salaries for INSTRUCTORS III, IV, and V shall remain as fixed by the Board of Regents at its 918th meeting in 1979 September.

B. The foregoing exception is premised on the principle that no reduction of salary can/Should be made in the process of implement- ing changes in the salary scale. Thereviewmade by OCPC, if imple- mented, would bring down the salaries of some instructors as follows:

Instructor III, from P16,092.00 to P16,044.00 InstructorIV,from P16,956.00 to P16,860.00; and Instructor V, from P17,868.00 to P17,724.00.

As Regards 'The Salary Schedule' and 'The Wage Schedule' Pre- scribedin P.O.985

A position paper is to beprepared for consideration at the July BR meeting, embodying the position of the Board of Regents, which is as follows:

A. The University will revise: the existing salary scales for ·the faculty, academic non-teaching and administrative personnel by using. in place of the current salary rates, or 'prescribed rates.' in the University's scales, (11 the 'prescribed rates' in 'The Salary Schedule' (for purposes of the salary scales for monthly paid personnel) and (2) the 'prescribed rates'in 'The Wage Schedule' (for purposes of the scale for daily paid personnel) provided for in Section 11 and Section 12, respectively, of P.O. 985.

Note: Both of the aforementioned pay schedules prescribed in P.O. 985 feature salary grades of 1 to 28._ each salary grade consist- ing of9regular steps.

B. While the University will use the 'prescribed rates' in the aforementioned 'Salary Schedule' anC: Wage Schedule' [hereinafter tobereferred to as 'OCPC 'prescribed rates' for shard in the process of revising/reconstructing the University salary scales and wage

• schedule, the University shall retain complete control/authority over all aspects of position classification. In other words, it will continue, without need for further action/approval/reviewbyOCPC, to:

1. revise/upgrade its salary scales and wage schedule, using, of course, the

'prescribed rates';

2. determine the salary range of salary 'grade allocation for each of the various faculty ranks and classes of academic non-teaching and administrative positions;

3. determine the number of regular salary steps for each salary range or salary grade or for each rank/class title;

4. classify/reclassify positions and prescribe corresponding qualification standards and official statements of duties therefor;

and

5. make changes in salary range/grade allocations and ranks/

designations/class titles in the plantilla of personnel.

C. The University will continue to exercise complete authority in the determination of schedules of honoraria and allowances.

PROVISIONAL REGISTRATION WITH DEFERRED PAYMENTS OF TUITION AND OTHER FEES

The Board allowed provisional registration with deferred pay- ments of tuition and other fees for incoming freshmen and trans!er students who apply for grants-in-aid beyond the regular deadline andother students in similar situations {e.q., recipients of private scholarships the funds for which, although entrusted to the Univer- sity. can be released per LOI 981 only through a special budget;

dependent of a faculty member who expected to receive his summer honorarium before the first semester registration but did not owing to budgeting/accounting/auditing requirements; etc.l

POLICY GUIDELINES ON THE UNIVERSITY'S REGIONAL UNITS

The Board of Regents considered a paper entitled "The Regional Units of the University of the Philippines: A Perspective" (prepared bv the President's Committee for the Regional Units) and approved the following policy guidelines with regardtoexisting regional units of the University:

1. Central administration shall have an explicit commitment to a Specific pace of development for each regional unit.

2. The regional units shallbealloned a significant share in the total U.P. budget.

3. There shall be an actual and effective decentralization of authority to enable the regional deans to decide and act with final- ity in important realms of field management.

ESTABLISHMENT OF CORDILLERA STUDIES CENTER The Board approved the establishment of the Cordillera Studies Center in U.P. College Baguio as an initial step towards the program for development studies in the College.

The Center will be the research and extension arm of the devel- opment studies program. With regard to both research and exten- sion, U.P. College Baguio will achieve better focus and perspective as the Center gradually becomes operational. Ongoing research and extension programs are already oriented to developmental goals in Northern luzon.

The establishment of the Center is approved on the understand- ing that its implementation, especially as regards additional budget- ary allocations, Will have to depend on the 1981 U.P. College Baguio

PHILIPPINE ENGINEERING JOURNAL

The Board authorized the National Engineering Center (NEC) to publish (from NEC funds! the Philippine Engineering Journat.

1. Two issues (June and December) for 1980; thereafter, quar- terly (depending on funds);

2. The June issue will bea32~page volume on energy, water resources, pollution control, earthquake designs, highway engineer- ing, etc.:

3. The NEC Executive Director, College of Engineering Dean, and the MEC Engineering Education Project Director will compose the editorial advisory board. Prof. Fortunato de Ie Pena will be editor-in-chief of the journal, with three NEC staff members as assistant editors.

REVISED RULES GOVERNING THE UPLB PERSPEC·

TIVE

The Board revised the Rules and Regulations governing the pub- lication of the UPLB Perspective, particularly the one-year residence requirement for editorship, as follows:

Article 5. (a) He must be a bona fide student of the UPLB with at least [one year] one semester of residence in the University."

(Words in brackets to be deleted; those underscored, to be inserted.}

Section 4, Par. 3, of the Rules states that "editorial examinations are conducted one month before the end of classes in the second' semester. A freshman who enrolled in the first semester lacks o·nly a month of residence to meet the 'one-veer' residence rule." Based on this rule, most applicants VIOuld have completed nearlytwoyears of residence which is beyond the intent of Article 5 (a).

OTHER MATTERS CONSIDERED BY THE BOARD The Board approved graduation of students who had completed the requirements for their respective degrees in the College of Arts and Sciences (OHiman), as of the end of Summer, 1980.

Rilles, and ordering the University "to assist [ Mr. Rilles] in every 'possible way in completing his enrolment on time."

In this connection, a memorandum, dated 25 June 1980, for the Board of Regents from the University General Counsel: •

"Atty. C. Padua, counsel for Mario Rilles, filed a petition for.

certiorari with a prayer for the issuance of a preliminary prohibitory injunction with the Court of First Instance of Quezon City. The parties/respondents are the University of the Philippines System, the Board of Regents, the President, and the University Counsel.

In view of the fact that enrollment is about to close, the Court issued an Order, dated 24 June 1980, requiring respondents to enroll petitioner Rilles.

We are challenging this Order by certiorari, prohibition, and preliminary injunction in the Court of Appeals, andwehope to file our petition either tomorrow or the day following.

A brief history of the case:

1. Respondent was a direct participant in a rumble in the premises of the College of Arts and Sciences on 30 August 1977, which resulted in the death of Rolando Abad, a student of the University.

2. The petition to review the decision of the President on 1 February 1978, upon the jurisdictional issue, was denied by the Board 190151. 27 April 197BI.

3. Found guilty along with others, respondent was eXpelled,.

effective 30 August 1977. pursuant to the decision of the Student ' Disciplinary Tribunal on 31 May 1978.

4. The Board of Regents at its 904th meeting (27 July 1978) approved the recommendation of the UniversitY General Counsel to deny the respondent's petition for reconsideration: but, pending final decision on the charge, Mario Rilleswasallowed to enroll in the University.

5. Rilles was disqualified from enrolling in the College of Engineering on grounds of academic deficiency.

6. Claiming that hewasnot afforded due process, U.P. President Onofre D. Corpuz set eside, on 19 September 1978, the SOT deci- sion, and remanded the case to the Tribunal for the reception of respondent's evidence.

7. An Orderwasissued by the Court of First Instance of Rizal on 19 July 1979 to allow Rilles to enroll for the First Semester, 1979-1980.

8. On 2 October 1979, the President found that the SOT had afforded respondent the amplest opportunity to present his Own evidence and, there being no countervailing evidence to disturb the findings of the SOT, the sentence of expulsion was confirmed.

9. Through Counsel, Rilles submitted a Motion to Dismiss or Alternatively for a Reduction of Penalty, dated 27 March 1979; a letter of appeal dated 23 May 1979 incorporating the same argu- ments, and a motion for reconsideration dated 23 October 1979, all strike the same note that he had nothing to do with the killing of the victim.

10. The President confirmed the sentence of expulsion on 15 February 1980.
