In order to simplify the preparation of the Bidding Documents for each acquisition, the PBDs group the provisions intended to be used unchanged in Section II. The Procuring Entity shall not accept any responsibility regarding erroneous interpretations or conclusions drawn by the Consultant from the data provided by the Procuring Entity. Unless otherwise specified in the BDS, the Consultant may subcontract portions of the Consulting Services to an extent approved by the Procuring Entity and stated in the BDS. In the event that any subconsultant is deemed ineligible by the Procuring Entity, the subcontracting of such portion of the Consulting Services shall be prohibited.
A sub-consultant identified by the consultant during contract execution must comply with the eligibility criteria and document requirements and secure approval from the procuring entity. Unless otherwise specified in the BDS, payment of the Contract Price shall be made in Philippine pesos. However, the client may refuse to make payments when the terms and conditions of the contract are not satisfactorily performed by the Consultant.

INSTRUCTIONS TO BIDDERS

The name of the project is Creation of Master Plans for the Leyte Normal University Campuses. The financial proposals of the consultants who meet the minimum technical score will then be opened. The weight of the technical criteria will be adjusted accordingly so that their total weight in percentage together with the weight given to the financial proposal contributes one hundred percent (100%).
The Financial Proposals will be opened in public in the presence of the Consultants' representatives who choose to attend. The name of the Consultant, the quality scores and the proposed prices will be read aloud and recorded when the Financial Proposals are opened. The BAC will determine whether the Financial Proposals are complete, i.e. whether all the documents mentioned in ITB Clause 11 are present and all items of the corresponding Technical Proposals required to be priced have been so priced.

GENERAL CONDITIONS OF CONTRACT
Subject to any additional provisions set forth in the SCC, the Consultant's liability under this Agreement shall be as provided by the laws of the Republic of the Philippines. The Consultant must give the Client written notice of its intention to terminate this Agreement at least thirty (30) calendar days prior to the intended termination. Equipment and materials made available to the consultant by the client or purchased by the consultant with funds provided by the client are the property of the client and will be marked accordingly.
With respect to other key personnel that the consultant proposes to use in the performance of the services, the consultant will submit this to the procuring entity for assessment. The contracting entity guarantees that the consultant has free and unhindered access to all lands in the Philippines to which access is required for the performance of the services. The consultant shall cooperate with and assist the contracting authority and its authorized representatives in conducting such an audit.
If the audit shows that the consultant has overcharged the contracting entity, the consultant will immediately reimburse the contracting entity an amount equal to the overpayment. The consultant shall notify the contracting authority once the cumulative costs for the services have reached eighty percent (80%) of this ceiling. The retainer is due after the consultant has issued an irrevocable standby letter of credit in favor of the procuring entity, issued by an entity acceptable to the procuring entity in accordance with the requirements of the SCC.
SPECIAL CONDITIONS OF THE CONTRACT
NOTE: Account details must be completed by the winning consultant prior to signing the contract. 20 "All joint venture partners are jointly and severally liable to the client.". 24 The time period is 150 calendar days or another time period agreed upon in writing by the parties.
Violators will be fined the amount of the refund of the basic rate of the replaced Personnel, which amounts to at least fifty percent (50%) of the total basic rate for the duration of the assignment. TERMS OF REFERENCE
To list and describe priority items within the campus master plan, including all details required in the following scope of services. The consultant is responsible for carrying out detailed geodetic cartography and planning the development of the location of all the complexes that make up the University. The consultant shall coordinate with the Leyte Normal University Engineering Office to minimize changes/modifications to design plans and unnecessary delays in the preparation of final plans and quantification.
The consultant must complete all mandatory tasks without delay, keeping the Leyte Normal University Engineering Office informed of all progress in terms of survey preparation, execution and processing. The consultant will create an inventory of all existing buildings, facilities and other infrastructure within the complexes and campuses. In order to assist with the evaluation, comparison and post-qualification of the offers, the contracting authority may request any consultant in writing for a clarification of his offer. Said results shall also be published in PhilGEPS and the website of the procuring entity, if available, for a period of at least seven (7) calendar days. A bid must be rejected at this stage if it does not respond to important aspects of the TOR or if it does not achieve the minimum technical score (St) specified in the BDS.
Once the contract has been awarded, no substitution shall be permitted until fifty percent (50%) of the personnel in the work months have been completed, except for justifiable reasons as may be determined by the Employer. Particular attention will be paid to obtaining the maximum that the consultant can offer within the available budget and clearly defining the inputs required from the client to ensure satisfactory project delivery. Where appropriate, BAC will lead the negotiations and, if successful, will subsequently qualify the consultant with the next highest rated offer.
A request for reconsideration may be submitted by the bidder to the HoPE pursuant to Section 37.1.3 of the IRR of RA 9184.
