(Foto: Pierre Vee Photography).

BRITS POS – BRITS - The Public Servants Association (PSA), representing thousands of police officers and other employees of the South African Police Service (SAPS), is extremely concerned about the continuing ambush and murder of on-duty police officers.
In one of the latest incidents, two Gauteng police officers were killed whilst awaiting a mortuary van. The Constable (29) and Sergeant (45) were attached to Boksburg-North Police Station. It is alleged that three suspects approached the two on-duty police officers and demanded their firearms.
The time has come for the South African Parliament to intervene and enhance current laws that would strongly deter any criminal to attack a police officer. Parliament should, amongst others, pass a special law with a minimum of 80 eighty years’
imprisonment if convicted in relation to an attack or murder of a police officer. It is only through harsher punishment that criminals may be deterred from attacking police officers to steals their firearms to use in their
criminal activities. These murders make it difficult for police officers to do their job and respond to calls as they do not know what awaits them. It cannot be acceptable that police officers are murdered in cold blood and their killers walk freely in communities.
Attacks on police officers threaten the security of the country and its citizens as police officers are at the front line of crime prevention and order in the country. The PSA calls upon political leaders in Parliament to urgently address the killing of police officers and pass a special law to stop lawlessness and violence in the country that have reached unprecedented levels. Police stations are even attacked, with firearms, ammunition, and other equipment being stolen.
This results in more firearms finding their way to unscrupulous criminals, which endangers police officers and communities.
It is unacceptable that the country has reached a state where police officers fear criminals and are treated as criminals when killing the same criminals whilst defending themselves.
Parliamentarians living protected lives must wake up to the realities and put measures in place to ensure that police officers are working in a conducive environment, without compromising their safety.
Their rhetoric and speeches at funerals of fallen police officers are empty tokens. In addition, the prosecution of criminals involved in attacks on police officers should be prioritised, with the harshest possible punishment being imposed on those found guilty of such acts.

BRITS POS – BRITS - Operations at the Brits Water Treatment Plant were put to a halt on Tuesday, 11 October following the flooding of water into the pump station, which left two pump motors submerged.
“The flooding occurred as a result of power failure at the plant,” says Tumelo Tshabalala, spokesperson of Madibeng. “Two motors were found to be damaged and were replaced after the process of draining out of the water and the plant was back in full operation the next day, on Wednesday.
“On Saturday to be specific, we experienced another power failure and after investigation, it was discovered that the cables supplying power to the Brits and Mothotlung pumps were faulty and had to be replaced. This problem affected supply of water to most areas under the Brits Water Scheme which
included Brits and surrounding areas - Oukasie, Mothotlung, Damonsville, Elandsrand, Sonop, Rabokala and Oskraal.
“The cable was replaced on Monday evening and subsequent to that the plant was back in full operation and water released to the affected areas. In the interim, whilst experiencing water shortages, the municipality provided affected communities with water using water trucks.
“The municipality wishes to apologise for the inconvenience caused by the water shortages and appeals to consumers to use water very sparingly,” Tshabalala concludes.

“Bome is ‘n geheime wêreld”
Daar was hy bevoorreg genoeg

New rules for Small Claims Court up to R20,000
(Image: businessinsider.co.za)
BRITS POS – BRITS - The Department of Justice and Constitutional Development has gazetted new rules regulating matters submitted to the Small Claims Courts in South Africa.
Small claims courts offer a quicker and easier way of resolving certain civil disputes that involve amounts up to R20,000 in the country.
The draft rules outline the procedures to be followed when making small claims, including all the necessary forms that must be filled in and submitted – by both applicants and defendants – and the fees involved.
Because the small claims court often deals with laymen in the legal processes, more leeway is given in the rules. This includes not having errors and misspellings with dates and figures invalidate claims, and not having default judgements against parties where certain rules aren’t complied with.
“If any party has been misled by any such error in any process served upon him or her, the court may on oral or written application grant such party relief as may be deemed just and may for that purpose set aside the process and rescind any default judgment given thereon,” the rules state.
The fees charged in the execution of court duties are also lower than one would expect from legal proceedings and billed to the mandator of the claim.
Issuing a summons comes with a charge of between R45.00 and R70.00, depending on the distance from the office;
*An attempted service of a summons between R37.50
and R63.00;
*Execution of a warrant between R63.00 and R87.50;
*An attempted execution between R52.00 and R79.50;
*In addition to these fees, the sheriff of the court is allowed a travelling allowance of R6 per kilometre travelled for the shortest possible route in executing their duties;
*Ejectment of a defendant is R22.50 for the first 30 minutes, thereafter R67.50 per hour;
*Other fees include charges for telephone calls, writing letters or emails related to the matter for R11.00;
sending faxes and emails for R6.50; and making copies of official documentation for R5.00.
If parties want to review the proceedings of the Small Claims Court, they would have to apply to the High Court. This can only be done on certain grounds, the rules state. These include:
*The small claims court does not have jurisdiction over the matter;
*There is an interest in the cause, bias or malice by the commissioner;
*There is a gross irregularity in proceedings;
The rules will come into effect on a date still to be determined by the justice and correctional services minister.

BRITS POS – BRITS – The recent strike at state-owned rail, port and pipeline company Transnet has not only crippled Transnet, but effectively shut down South Africa’s ports and backlogs might affect the availability of many items on store shelves soon.
Billions of rands were lost on a daily basis with the strike action by three unions representing the workers on the strike over wages, shutting down critical import and export infrastructure.
Over 40,000 employees had downed tools.
The consequences of the strike will only be experienced later and therefore consumers must be prepared for possible fuel shortages at petrol stations.
Although agreements have been reached with unions, the situation is still volatile and the crisis affects everyone and will have far reaching consequences.
South Africa will soon experience a
food, petrol and deeper load shedding
crisis
BRITS POS – BRITS - Mid-month data published by the Central Energy Fund (CEF) shows that petrol and diesel prices in South Africa could be going up next month, following an early month shock for oil and continued pressure on the rand.
The data, which serves as a snapshot of market conditions as of 13 October 2022, shows that the petrol price could climb by 48 cents per litre in November. Diesel, meanwhile, shows a much larger under-recovery – thus potential increase of R1.57 per litre.
The mid-month snapshot is as follows:
* Petrol 93: increase of 48 cents per litre;
* Petrol 95: increase of 38 cents per litre;
* Diesel 0.05%: increase of 154 cents per litre;
* Diesel 0.005%: increase of 157 cents per litre;
* Illuminating Paraffin: increase of 571 cents per litre.
The Department of Energy has stressed that the daily snapshots are not predictive and do not cover other potential changes like slate levy adjustments or retail margin changes, which are determined by the department at the end of the month, taking all variables into account.

Persoon noodlottig beseer
BRITS POS – BRITS - Stellenbosch University’s legal expert Karin Calitz says that legislation changes or a national code of practice need to be put in place in South Africa to allow workers to ‘disconnect’ from work, as burnout amongst employees has become a growing concern.
Burnout is not a new phenomenon and can be described as a particular type of work-related stress resulting in a state of physical or emotional exhaustion – often caused by being overworked.
Experts attribute the resurgence of burnout to the Covid-19 pandemic, which shifted the working environment from the office to the home, according to BusinessTech.
“This shift meant that work and personal boundaries became blurred, creating an environment where employees were reachable 24/7 – doing more than they
ordinarily would, compared to being in the office, which is regulated by office hours,” says Calitz.
There are no labour laws in South Africa that are targeted explicitly at long hours, overwork and tight deadlines – and Calitz believes this is negatively affecting employees’ health and productivity.
According to Calitz, the International Labour Organisation conducted a study during the pandemic in 2020 and found that Covid-19 exacerbated burnout, especially for employees that had children.
She added that surveys in the UK showed that 40% of
employees suffered from burnout over the same period. A two-year follow-up report showed that these numbers are not declining.
“Burnout is taking on epidemic proportions globally, and South Africa is no exception,” she said.
Calitz said that South Africa should adopt legislation that allows employees to disconnect from work communications after office hours – prescribed in their contracts – and bar employers from sending out those communications.
If not legislation, then South Africa should put in place a national
“code of good practice”, she said. This would require employers to sit down with their employees or respective unions to determine a suitable code that the employer will contractually abide by to avoid penalties.
“South Africa would not be the first country to make such a move and that countries such as France, Italy, Germany, and other European countries have adopted ‘Right to Disconnect’ legislation,”
Calitz added.
France was the first European country to introduce the Right to Disconnect legislation in 2016, which refers to a worker’s right to be able to disengage from work and refrain from engaging in work- related electronic communications, such as emails or other messages, during non-work hours.
This legislation is now regulated by the Labour Code in France, and any company that infringes upon it could face fines of up to
€4,080 (R72,175).

Success in Namibia
BRITS POS – BRITS – Every year the month of October has been dedicated to football by the coastal community of Swakopmund in Namibia and the players of Brits Soccer Academy (BSA) participated successfully in this international soccer tournament.
This is the second year this soccer event was hosted, with teams from across the Southern African Development Community (SADC) region competing to be crowned the best of the best.
This year the tournament had a different take as Brits Soccer Academy based in the North West, South Africa became the co-host of the tournament in Namibia. The collaboration was vital for best prac- tice, sportsmanship hence the tourna- ment was renamed Brits-Mondesa inter- national youth tour- nament.
BSA left the country on 3 October 2022 with 28 players and eight management staff to participate in the ultimate showdown.
The group re- presented both u.17 and u.21 divisions.
The first group stage matches were played on 5 October where BSA managed to win all the group matches finishing top of the
group for u.21 and headed to the semi-finals while the u.17’s was knocked out in the group stages. The u.21’s then lost to Swakopmund FC on penalties after a one all draw.
The second instalment of the Mondesa tournament has by far brought a lot of stiff competition and hunger to win for those that took part and also to form partnerships.
BSA director of development Dr. Tshiamo Ramalepa says the academy gave its all during this tournament and penalties are always a gamble and can go either way, but the players of BSA had great structure and competitive football was displayed by them.
Dr. Ramalepa adds that the team is back from Namibia and will now focus on the domestic competition which is the preliminary Nedbank cup games, and the SAB League games which are scheduled to take place this Saturday.
The chairman of Brits Soccer Academy, Tembo Mayanja has thanked the organisers of the tournament for their wonderful hospitality and for true sportsmanship displayed during their stay in Namibia.
Mayanja also passed his gratitude on to the parents of the 28 boys and many others for their continued support and making this trip successful, he says its back to business now as the focus is on the leagues.

BRITS POS – BRITS - Wagpos se kultuur in 2022 skitter helderder as enige ster!
(Foto’s verskaf)
