ABSTRAK
Bank berperan sebagai sarana menghimpun dan menyalurkan dana nasabah. Bank menjadi tempat kepercayaan nasabah dalam menyimpan dan menggunakan jasa-jasa bank. Bank dalam menjalakan fungsi dan kegiatan usahnya bank wajib menerapkan prinsip kehati-hatian dalam rangka melindungi dana nasabah yang dipercayakan padanya. Kepercayaan nasabah pada bank akan terjaga apabila sektor bank itu sendiri terpelihara kondisi kesehatannya. Permasalah yang terjadi ketika bank melakukan praktek memperdagangkan produk secara illegal yang menimbulkan kerugian bagi nasabah. Akan tetapi bank yang memperdagangkan produk secara illegal itu telah berganti nama. Dalam tugas akhir ini yang menjadi tujuan penulis bertujuan mengetahui bagaimana status kedudukan bank dan tanggung jawab bank yang telah berganti nama terhadap bank lama dalam mengganti rugi dana nasabah atas memperdagangkan produk bank secara ilegal dihubungkan dengan undang-undang perbankan.
Penelitian ini bersifat deskriptif analitis dengan menggunakan metode pendekatan yuridis normatif dan tahap pengolahan dan analisis data dilakukan secara yuridis kualitatif.

MUTIARA BANK'S LIABILITY IN INDEMNIFICATION OBLIGATIONS OF
THE CENTURY BANK CUSTOMER'S FUNDS RELATED TO BANKING
REGULATION
ABSTRACT
Bank plays a role as a vehicle to collect and to channel customer
funds. Bank is a place to which customers use its service and trust their
funds. In exercising its functions and activities, the bank are required to
apply the precautionary principle in order to protect customers' funds
entrusted to the bank. Customer trust in the bank sector will be
maintained if the bank's health itself is well maintained. The problem
occurred when the bank makes a product illegal trade practices harming
their clients. However, the bank trading illegal products has changed its
name. The purpose of this final task is the position and status and to find
out the liabilities of the renamed bank in indemnifying customer funds
under old bank name due to illegally trade the bank product related to the
banking regulation.
This is a descriptive-analytical study using normative juridical
approach by linking the object of research with the applicable regulations
based on the bibliography and interview with the concerned parties. And
stage of processing and analysis done legally qualitative.
The research suggests that the renamed bank does not change its
liabilities to indemnify its losses-suffered customer. Bank Indonesia
Regulation Number 11/1/PBI/2009 on Article 57 describes that the bank
allowed changing its name and the change is only in the bank name
without changing its authority. Liabilities of the bank can be seen for article
29 paragraph 4 of the Banking Act states that the bank must inform
potential risk of loss of the client transaction in the bank's business
