MEMORANDUM SALING PENGERTIAN ANTARA

KEMENTERIAN LUAR NEGERI REPUBLIK INDONESIA DAN

KEMENTERIAN LUAR NEGERI REPUBLIK ISLAM AFGHANISTAN MENGENAI

KONSULTASI BILATERAL

Kementerian Luar Negeri Republik Indonesia dan Kementerian Luar Negeri Republik Islam Afghanistan (selanjutnya disebut "Para Pihak"),

MENGETAHUI penguatan hubungan bilateral antara Indonesia dan Afghanistan seperti yang ditunjukkan dengan adanya kerjasama di tingkat pemerintah maupun non pemerintah,

BERHASRAT untuk memperkuat hubungan persahabatan antara kedua negara dan masyarakat dan untuk meningkatkan dialog dan kerjasama berdasarkan prinsip saling menghormati, kemanfaatan bersama, dan prinsip kedaulatan yang setara,

BERKEINGINAN untuk mengembangkan hubungan yang konkrit dan mendorong lebih banyak konsultasi-konsultasi langsung antara kedua Pihak pada semua tingkatan,

MENGAKUI perlu adanya suatu mekanisme untuk konsultasi antara kedua Pihak mengenai hal-hal yang menjadi kepentingan bersama,

SESUAI dengan peraturan perundang-undangan yang berlaku di kedua negara,

TELAH MENCAPAI saling pengertian sebagai berikut:

PASAL 1 TUJUAN

Para Pihak dengan ini membentuk konsultasi politik secara berkala pada tingkat Menteri Luar Negeri atau Wakil Menteri atau Pejabat Senior antara Kementerian Luar Negeri Republik Indonesia dan Kementerian Luar Negeri Republik Islam Afghanistan untuk meninjau dan mengkaji segala aspek hubungan bilateral kedua negara dan membahas modalitas untuk memperluas dan mempererat kerjasama antara Para Pihak serta mernbahas masalah-masalah regional dan internasional yang menjadi kepentingan bersama.

PASAL 2

MEKANISME KONSUL TASI

1. Konsultasi akan diselenggarakan setiap tahun sekali atau apabila dipandang perlu, secara bergiliran di Indonesia dan Afghanistan. Perincian terkait tanggal, tempat, agenda dan tingkat delegasi pada Konsultasi tersebut akan disepakati melalui saluran diplomatik.

2. Para Pihak akan menjamin kerahasiaan hasil-hasil Konsultasi Bilateral termasuk dokumen, dan informasi yang dipertukarkan, dan tidak akan memindahkan atau memberikan hal-hal tersebut kepada pihak ketiga tanpa persetujuan sebelumnya dari Pihak lainnya.

3. Konsultasi ini akan mendorong perwakilan diplomatik dan konsuler mereka termasuk Perwakilan Tetap untuk Perserikatan Bangsa-Bangsa (PBB) dan organisasi internasional lainnya, serta delegasi mereka untuk Konferensi-konferensi PBB dan Konferensi-konferensi internasional lainnya, untuk membina kerjasama yang erat dan saling mempertukarkan informasi dan pandangan atas hal-hal yang menjadi kepentingan bersama.

PASAL 3

RUANG LINGKUP KERJASAMA

Para Pihak akan melakukan konsultasi dan pertukaran pandangan mengenai hal-hal berikut:

1. lsu-isu bilateral termasuk politik, ekonomi, kebudayaan, ilmu pengetahuan, sosial, pendidikan, serta isu-isu lain yang menjadi kepentingan bersama.

2. lsu-isu global yang termasuk di dalamnya isu-isu yang berkaitan dengan PBB dan organisasi-organisasi internasional lainnya yang menjadi kepentingan bersama.

PASAL 4 AMANDEMEN

Memorandum Saling Pengertian ini dapat direvisi atau diubah dengan persetujuan bersama kedua Pihak. Perubahan dimaksud mulai berlaku pada tanggal yang disepakati bersama oleh kedua Pihak.

PASAL 5

PENYELESAIAN PERBEDAAN

Perbedaan-perbedaan yang timbul dari interpretasi atau implementasi

Memorandum Saling Pengertian ini akan diselesaikan secara damai melalui konsultasi atau negosiasi.

PASAL 6

PEMBERLAKUAN DAN PENGAKHIRAN

SEBAGAI BUKTI, yang bertanda tangan di bawah ini, menandatangani \t1emorandum Saling Pengertian ini,

DIBUAT di Bali, Indonesia, pada tanggal 9 bulan November tahun 2012 sama jengan 19/8/1391 , dalam dua naskah asli, dalam bahasa Indonesia, Pashto, L>ari, dan lnggris, semua naskah mempunyai kekuatan hukum yang sama.

ｾｰ｡｢ｩｬ｡＠ terdapat perbedaan penafsiran Perjanjian ini, maka naskah bahasa

lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF INDONESIA AND

THE MINISTRY OF FOREIGN AFFAIRS OF THE ISLAMIC REPUBLIC OF AFGHANISTAN

ON

BILATERAL CONSULTATIONS

The Ministry of Foreign Affairs of the Republic of Indonesia and the Ministry of Foreign Affairs of the Islamic Republic of Afghanistan (hereinafter referred to as "the Parties");

ACKNOWLEDGING the strengthening of bilateral relations between the Republic of Indonesia and the Islamic Republic of Afghanistan as reflected by the existing cooperation at the governmental and non-governmental levels;

DESIRING to strengthen friendly relation between the two countries and peoples and enhance dialogue and cooperation based on mutual respect, common benefit and the principles of sovereign equality;

WISHING to develop a relationship that is concrete and to foster more direct consultations between the Parties at all levels;

RECOGNIZING the need to create a mechanism for consultations between the Parties on matters of common interests;

HAVE REACHED the following understanding:

ARTICLE 1 OBJECTIVES

The Parties hereby establish regular political consultations, at the level of Foreign Ministers or Vice/Deputy Ministers or Senior Officials between the Ministry of Foreign Affairs of the Islamic Republic of Afghanistan to review and examine all aspects of their bilateral relations and to discuss modalities of extending and deepening the cooperation between the Parties as well to discuss regional and

international issues of common interest. I

ARTICLE 2

MECHANISM OF CONSULTATIONS

1. The consultations will be held annually or as deemed necessary, alternately in Indonesia and Afghanistan. The details concerning date, venue, agenda and level of representative of the consultations will be agreed upon through diplomatic channels.

2. The Parties will guarantee the confidentiality of bilateral consultations, including documents and information exchanged, which shall not be transferred to a third party without prior consent of the other Party.

3. The consultations will encourage their diplomatic missions and consular posts including their permanent missions to the United Nations and other international organizations, as well as their delegations to the United Nations conferences, to maintain close cooperation and to exchange information and views on matters of mutual interest.

ARTICLE 3

SCOPE OF COOPERATION

I The Parties will carry out consultations and exchange of views on the following

matters: I

1. Bilateral issues which include political, economic, cultural, scientific, social educational co-operations, as well as other issues of mutual interest.

2. Global issues may include issues relating to the United Nations and other international organization of common interest.

ARTICLE 4 AMENDMENT

The Memorandum of Understanding may be revised or amended by mutual consent of the Parties. Such revision or amendment will enter into force on a date mutually decided by the Parties.

ARTICLE 5

SETTLEMENT OF DIFFERENCES

Any differences on the interpretation or implementation of this Memorandum of Understanding will be settled amicably through consultations or negotiations.

ARTICLE 6

ENTRY INTO EFFECT AND TERMINATION

This Memorandum of Understanding will come into effect on the date of its signing and will remain operation for period of 5 (five) years, and will be renewed automatically for successive 5 (five) years unless either Party notifies in written 3 (three) months prior to this intention to terminate this Memorandum of Understanding through diplomatic channels.

DONE IN two original texts at Bali, Indonesia, on this gth day of November in the

year of 2012 equal to 19/8/1391 , in Indonesian, Pashto, Dari and English

languages, all texts being equally authentic. In case of any divergence of

interpretation, the English text shall prevail.
