NOTA KESEPAHAMAN ANT ARA

KEMENTERIAN KOORDINATOR BIDANG PEREKONOMIAN REPUBLIK INDONESIA

DAN

KOMISI PEMBANGUNAN NASIONAL DAN REFORMASI REPUBLIK RAKYAT TIONGKOK

ATAS PELAKSANAAN KERJA SAMA EKONOMI

Kementerian Koordinator Bidang Perekonomian Republik Indonesia dan Komisi Pembangunan Nasional dan Reformasi Republik Rakyat Tiongkok (selanjutnya

disebut "Para Pihak");

Berharap untuk meningkatkan hubungan ekonomi antara Indonesia - Tiongkok

ke tingkat yang lebih tinggi sesuai hasil The First High Level Economic Dialogue

yang telah dilaksanakan di Beijing pada tanggal 26 Januari 2015;

Merujuk pada Pernyataan Bersama mengenai Kemitraan 8trategis antara Republik Indonesia dan Republik Rakyat Tiongkok yang ditandatangani di Jakarta pada tanggal 25 April 2005;

Mempertimbangkan Rencana Aksi untuk lmplementasi Pernyataan Bersama antara Presiden Republik Indonesia dan Presiden Republik Rakyat Tiongkok atas Pernyataan Bersama yang ditandatangani di Jakarta pada tanggal 21

Februari 201 O;

Mengingat Kesepakatan Expanding and Deepening Bilateral Economic and Trade Cooperation antara Pemerintah Republik Indonesia dan Pemerintah

Republik Rakyat Tiongkok atas yang disepakati di Jakarta pada tanggal 29 April 2011 ;

Sesuai dengan hukum dan ketentuan yang berlaku di masing-masing negara;

TELAH MENCAPAI kesepahaman sebagai berikut:

Tujuan Pasal 1

Tujuan dari Nota Kesepahaman ini adalah untuk membuat kerangka koordinasi kebijakan kerja sama ekonomi dan implementasi praktis terkait industri, investasi,

keuangan, pertanian, energi, teknologi, pembangunan Kawasan Ekonomi dan lnfrastruktur untuk mencapai keharmonisan pembangunan ekonomi dan sosial

Focal Point

Pasal2

Terkait implementasi Nota Kesepahaman ini, koordinasi akan dilakukan oleh Deputi Kerja Sama Ekonomi lnternasional Kementerian Koordinator Bidang Perekonomian Republik Indonesia dan Wakil ketua Komisi Pembangunan

Nasional dan Reformasi Republik Rakyat Tiongkok.

Para Pihak sepakat untuk mendirikan sekretariat bersama yang bertanggung jawab untuk mengkomunikasikan dan mengkoordinasikan serta mengerjakan tugas-tugas yang terkait Nota Kesepahaman ini. Sekretariat dari Pihak Tiongkok

adalah Departemen Kerja Sama lnternasional National Development and

Reformation Commission, dan sekretariat dari Pihak Indonesia berada di

Kementerian Koordinator Bidang Perekonomian.

lmplementasi

Pasal 3

Para Pihak akan berkoordinasi melalui konsultasi di bidang ekonomi untuk mengeksplorasi kesempatan kerja sama yang lebih luas serta akan

mendiskusikan tantangan ekonomi dan pembangunan.

Pasal4

Para pihak sepakat untuk bertemu setiap tahun secara bergantian di kedua

negara pada saat yang telah disepakati bersama, dengan tujuan

mengidentifikasi berbagai bidang dan proyek kerja sama utama,

mengembangkan rencana kerja serta menyelesaikan isu-isu utama yang

menjadi perhatian bersama. Pertemuan-pertemuan di luar pengaturan dimaksud

Pasal 5

Para Pihak sepakat untuk meningkatkan kerja sama energi di bidang industri pembangkit tenaga listrik, industri batu bara, industri minyak dan gas, energi

terbarukan dan energi nuklir. Komisi Pembangunan Nasional dan Reformasi menunjuk National Energy Administration Republik Rakyat Tiongkok untuk melaksanakan kerja sama dimaksud bersama Kementerian Koordinator Bidang Perekonomian Republik Indonesia.

Forum Energi Indonesia - Tiongkok akan kembali dilaksanakan pada tahun 2015, dipimpin bersama oleh National Energy Administration Republik Rakyat Tiongkok dan Kementerian Koordinator Bidang Perekonomian Republik

Indonesia.

Pasal6

Rincian dari implementasi Nota Kesepahaman ini akan dilaksanakan melalui

pengaturan bersama yang disepakati oleh Para Pihak.

Kerahasiaan

Pasal 7

1. Setiap Pihak harus mengambil semua langkah yang diperlukan untuk menjamin kerahasiaan semua dokumen dan informasi yang dipertukarkan dalam rangka impelemntasi Nota Kesepahaman ini atau kesepakatan

lainnya yang dibuat berdasarkan Nota Kesepahaman ini.

2. Para Pihak sepakat bahwa pasal-pasal dalam Nota Kesepahaman ini

mengikat Para Pihak tanpa mengesampingkan terminasi atas Nota

3. Ketentuan Pasal ini tidak akan mengurangi hukum dan peraturan perundang-undangan dari Para Pihak.

Penyelesaian Persengketaan

Pasal8

Persengketaan yang timbul dari perbedaan interpretasi dan/atau implementasi Nota Kesepahaman ini akan diselesaikan secara kekeluargaan melalui negoslasl atau konsultasi antara Para Pihak.

Amandemen

Pasal9

Nota Kesepahaman ini dapat diamandemen pada saat yang telah disepakati

oleh Para Pihak. Amandemen dimaksud menjadi kesatuan yang tidak dapat

dipisahkan dari Nota Kesepahaman ini.

Masa Berlaku dan Pemberhentian

Pasal 10

1 . Perjanjian Kerjasama ini berlaku sejak tanggal penandatanganan oleh Para

Pihak

2. Perjanjian Kerjasama ini berlaku selama 5 (lima) tahun dan dapat dilanjutkan atau dihentikan berdasarkan kesepakatan Para Pihak atau dihentikan melalui notifikasi tertulis oleh salah satu Pihak 6 ( enam) bu Ian terlebih dahulu

kepada pihak lain

3. Penghentian Nota Kesepahaman ini tidak akan mempengaruhi masa berlaku proyek yang sedang berjalan atau aktifitas lainnya sampai proyek atau

SEBAGAI BUKTI yang bertandatangan dibawah ini, telah menandatangani

Nota Kesepahaman ini

Demikian perjanjian ini dibuat rangkap dua dan ditandatangani oleh Para Pihak di Beijing pada tanggal 26 Maret 2015, dalam 3 (tiga) bahasa, Mandarin,

Indonesia dan lnggris, seluruh naskah mempunyai kekuatan hukum yang sama.

Dalam hal timbul penafsiran yang berbeda, maka yang berlaku adalah versi bahasa lnggris.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE COORDINATING MINISTRY FOR ECONOMIC AFFAIRS , OF THE REPUBLIC OF INDONESIA

AND

THE NATIONAL DEVELOPMENT AND REFORM COMMISSION OF THE PEOPLE'S REPUBLIC OF CHINA

ON UNDERTAKING ECONOMIC COOPERATION

The Coordinating Ministry for Economic Affairs of the Republic of Indonesia, and

The National Development and Reform Commission of the People's Republic of China (hereinafter referred to as the "Parties");

Wishing to increase Indonesia-China economic relations to a higher level as a result of The First High Level Economic Dialogue held in Beijing on January 26, 2015;

Desiring to enhance the bilateral economy cooperation between two countries including but not limited to infrastructures, energy, industry and other

economical related areas.

REFERRING

to the Joint Declaration between the Republic of Indonesia and the People's Republic of China on Strategic Partnership signed in Jakarta on

TAKING INTO ACCOUNT the Plan of Action for the Implementation of Joint Declaration between the President of the Republic of Indonesia and the President of the People's Republic of China on Strategic Partnership, signed in

Jakarta on February 21 , 201 O;

RECALLING the Agreement between the Government of the Republic of Indonesia and the Government of the People's Republic of China on Expanding and Deepening Bilateral Economic and Trade Cooperation concluded in Jakarta on 29 April 2011 ;

PURSUANT to the prevailing laws and regulations in their respective countries;

HAVE REACHED the following understandings:

Objective Article 1

The purpose of Memorandum of Understanding (hereinafter referred as the MoU) is to establish framework for coordination of policies on economic cooperation

and practical implementation with respect to industry, investment, finance,

agriculture, energy, technology, development of economic zones and infrastructure to achieve economic and social harmonious development on both

countries.

Focal Points Article 2

For the purposes of the implementation of this MoU, the focal points will be:

Coordinating Ministry For Economic Affairs of the Republic of Indonesia and Vice Chairman in charge of International Cooperation of the National Development and Reform Commission of the People's Republic of China.

The Parties agree to establish a joint Secretariat, responsible for daily communication and coordination and carrying out related tasks under this MoU.

The Secretariat of the Chinese side is located in in the Department of International Cooperation of the National Development and Reform Commission, and the Secretariat of the Indonesian side is located in the Coordinating Ministry

For Economic Affairs.

Implementation Article 3

The Parties will coordinate through consultation in economic fields in an effort to

explore greater cooperation opportunities and address economic and development challenges.

Article 4

The Parties agree to meet annually on mutually agreed date in each of the two

countries alternately, for the purpose of identifying key cooperative areas and projects, develop a working plan and solve major issues of mutual concern.

Extra-ordinary meetings at different levels shall be held with mutual consent.

Article 5

The Parties agree to enhance the bilateral energy cooperation in the areas of

power generating industry, coal industry, oil & gas industry, new and renewable

appoints thG National EnGrgy Administration of P. R. China as thG implGmGnting agency to conduct the above-mentioned cooperation with the Coordinating Ministry for Economic Affairs of the Republic of Indonesia.

The China-Indonesia Energy Forum will be resumed in 2015, co-chaired by the National Energy Administration of P. R. China and the Coordinating Ministry for Economic Affairs and the Ministry of Energy and Mineral Resources of Republic

of Indonesia.

Article 6

The details of the implementation of this MoU would be carried out through

special arrangements to be concluded by the Parties;

Confidentiality Article 7

1. Each Party shall undertake to observe the confidentiality and secrecy of documents, information and other data received or supplied to the other Party

during the period of the implementation of this MoU or any other agreements made pursuant to the MoU.

2. The Parties agree that the provision of this Article shall continue to be binding between the Parties notwithstanding the termination of this MoU.

3. The provision of this Article shall not prejudice the prevailing laws and

Sottlomont of Disputos Article 8

Any dispute arising out of the interpretation and/or implementation of this MoU

shall be settled amicably through negotiations or consultations between the Parties.

Amendment Article 9

This MoU may be amended at any time in writing by the mutual consent of the Parties. Such amendment shall form an integral part of this MoU.

Effectiveness, Valid Term and Termination Article 10

1. This MoU shall entry into force on the date of its signing.

2. This MoU shall remain in force for a period of 5 (five) years and may be extended by mutual consent of the Parties or terminated at any time by either

Parties by giving written notification at lease 6 (six) months prior to the date of

the intended termination.

3. The termination of this MoU will not affect the validity and duration of any

on-going project or activities until the completion of such project or activities.

DONE in duplicatG at 8Gijing, China, on March 26, 2015, in thG ChinGsG, Indonesian and English languages, all texts being equally authentic. In case of any divergence on the interpretation of this MoU, the English text shall prevail.
