Dal\lfil hal karet Republ ilc Indonesia dapat menjera.PJ~a.n hingga kira2 duabelas ribu ton setiap tahun.

Untuk memberi kesempatan kepada pengekspor2 Indonesia untuk meren

-tjanakan sebelunmja, pengiriman2 karet mereka ke Meksiko _Serikat, pengim -por-pengimpor Meksiko akan memberitahukan kepada pengekspor2 Indonesia

sembilan puluh hari sebelumnja mengenai djumlah serta sustman kebutuhan karet mereka untuk dua belas bulan jang berilrnt.

Adapun pemberitahuan ini akan clisainpaikan melalui Seoretaria de Industria y Comerci0. Meksilco.

Djika karena sesuatu sebab, pengekspor2 Indonesia tidak dapat me

-ngirim beberapa mutu dan 15.jumlah karet tertentu dalam waktu jang d.ikehen

-daki, maka pengimpor2 Meksiko al an bebas untuk menutup kontro.k pembelian2 ini dipa:sara.l'l l ain, asalka.n sad.ja ketidalc-mempua.n ini, njata memuaskan bagi Secretaria de Industria y Corercio Meksilrn

del Convenio Comercial existente entre ambas Repdblicas, firmado el lo. de noviembre de 1961 en la Ciudad de M'xico, convienen en revisar el Protocolo al cita-do Convenio Comercial.

El Protocolo Revieado,que constituye parte integral del Con-venio Comercial entre amboe pa!ses, se celebra conforme a las siguientes bases:

Las partes Contratantes convienen en que los precios de loe productos a entregarse en los t~rminos de este Convenio, se determinanln sobre la base de aquellos que prevalezcan en los mercadoe mundiales representativos en el momento en que se celebren los contratos de venta correspondientes.

ARTICULO IV

Los productos y valores listados son el resultado de apre--ciaciones mutuas del nivel actual del comercio, as! como de una estimaci6n del posible desarrollo del intercambio come,£ cial entre las Partee Contratantes. Los valores mencionados pueden alcanzarse o superarse de acuerdo con las circunstai_ cias que prevalezcan.

ARTICULO V

Los productos listados con

provenientes de la otra Parte Contratante, ee entiende que se cenirdn a la demanda de los consumidores finales.

ARTICULO IX

En cuanto a1 hu1e, ee declara que la Republica de Indonesia esta en posibilidad de entregar anualmente hasta 12,000 to-neladas, aproximndamente.

Con el prop6sito de que los exportadores indoneses tengan la posibilidad de programar con la debida anticipaci6n sue suministros de hule a M~xico, los importadores mexicanos in form.a.ran a los vendedores indoneses, con una anticipaci6n de por lo menos noventa diae, las cantidades y la composi-ci6n de sus necesidadee para los pr6ximos doce meses. Esta inf onnaci6n sera entregada por conducto de la Secretar!a de Induetria y Comercio de M6xico.

Cuando por cualquier circunetancia los exportadores indone-ses no est6n en condiciones de ef ectuar entregas de determ,! nadas calidades y cantidades de hu1e en los per!odos reque-ridos, los importadores mexicanoe quedar8n en libertad de contratar su compra en otros mercados, previa comprobaci6n, a eatisfacci6n de la Secretar!a de Industria y Comercio de M6xico, de tal imposibilidad.

ARTICULO X

En

el caso de la importaci6n de canela y pimienta, el GobE:lr no de los Estados Unidos Mexicanos procurart1 aplicar el mis-mo procedimient~ administrativo establecido para las adquie!

cionee de hule.

ARTICULO l l

En relaci6n con el Articulo VIII, parrato b) del Convenio C.2, mercial, que<;ia convenido que la Parte Contratante que es

miembro de la Asociaci6n Latinoamericana de Libre Comercio, se obliga a no otorgar a los signatarios del Tratado de Mon-tevideo concesionee reepecto a loa productoa incluidos en la Lista Dos de este Protocolo, que no sean igualmente concedi-das a la otra Parte Contratante. Esta Ultima parte asume la misma obligaci6n, con referencia a la Lista Uno, en caso de

participar en una Zona de Libre Oomercio o en una Un16n AduA nera.

ARTICULO XII

Las Partee Contratantes establecerrui. el mecanismo neceeario para asegurar que loe productos listados llenen los requiei toe, p~cticas y usos del comercio internacional, con ree--pecto a clasificaciones, calidades y precioa.

The Contracti.nc Parties aeree that the prices of the products to be

delivered under this Acreement will be determined on the basis of prices in representative world markets prevailin& at the time the relative contracts of sale of the products concerned are siCl18d•

ARTICLE IV

The listed products and values are the result of mutual evaluations of the present level of trade, as well as an estimate of the possible

development of the commercial interchan.ce between both Contraotinc Parties. The aforesaid va1ues may be reached or surpassed accord.inc to the prevailinc

circumstances.

ARTICLE V

The products speci:fied •pro memori" are co11111odities in which the

ContractiDc Party in question is interested in and is importin& at the present

time. They are products which could be included in an increase in the volume

The import of some of the listed products is subject to the volume

produced domesticall,y in each Contractin& Party. Both parties agree to make

their best ef'forts to import the deficit :from the other Party•

The values of the products listed may be reduced for reasons of

balance of p8i1Jll8nts diff'i.culties.

ARTICLE VIII

Imports into Ind.onesia alld into the United Mexican States or~inating

from the other country are Ullderstood to conform to the dema.Dd of ultimate

consumers.

ARTICLE IX

With regard to rubber, the Republic of Indonesia is in a position to

deliver each year up to twelve thousands tons appro.xilaate]3.

In order to give Indonesian exporters the opportm:dty to plan their

rubber supplies to the United Mexican States well in advance, the Mexican

importers will :inform... the Indonesian exporters, with an anticipation of ninety

days, about the volume and the composition of their rubber needs for the next

twelve months. This information will be submitted thl-ough the Secretaria de

Indust1'ia y Commercio of Mexico.

It for 8.t\V reason the Indonesian exporters should not be able to IDS.ks

deliveries of certain qualities and amounts 0£ rubber within the required

period, then the Mexican importers will be free to contract these purchases

in other markets, provided that this inability is proved to the satisfaction

of the Secretaria de Induatria y Commercio of Mexico.

ARTICLE X

The Government of the United Mexican States wil1 endeavour to app~

to the imports of cassia vera (cinnamon) and black pepper the same

it is acreed that the Contracti.Dg Party which is a member of' the Le.tin

Aaerican Pree !rade Association, assumes the obligation not to grant to other

signatories of the Montevideo Treaty &I\Y concession on the products mentioned

in List Two of this Protocol. which are not equally extended to the other

Contracting Party. The latter Party assumes the same obligation with

reference to List One, in the event of participatin& in a Jl>.ree Trade Zone

or a Customs Union.

ARTICLE XII

Both Contracting Parties shall establish a procedure to assure that

the listed products shall meet the requirements, practices aDd. usances of

international trade in terms of classifications, qualities and prices.

ARTICLE XIII

The Central Banks of both Contracting Parties shall establish a

payments agreement which wil.1. facilitate an expanding and mutual.13' beneficial

volume of trade.

ARTICLE .JIV

The C.Overnments of the Republic of Indonesia and the United Mexican

States agree to co-operate closel,y in shipping matters in order to encourage

the direct £low of goods between the two countries.

ARTICLE XV

This Revised Protocol may be rerlsed through annual consultations to

be held alternatively in the capital of each Contracting Party, with the

understanding that the next meeting will be held in Mexico City.

It was agreed that the two Contracting Parties would support and. enscourage the establishment of a regular commercial shipping route between the two countries which would, in addition to carrying goods transacted

between the two countries, also secure such other cargoes e.a deemed necessar,y . in order to operate economically. In order that such a route be established,

consultations would be held between the competent organisations of the two

countries regarding scheduling, routing and other operational aspects with a view to ensuring services that are in line with trade requirements. Such a route would also be given favourable consideration by the two Parties with regard to the allotment of cargoes carried in the trade between the two countries.

The two Contracting Parties agreed to grant the ships operated by

nationals and companies of the other Party treatment at least as favourable

as that granted to ships operated by nationals and companies of all third

countries in the matter of securing business in the shipment of goods between

the two countries.

It was aho agreed that the details of this understanding would be

worked out by the competent organisations designated by the two Governments.
