-(3) Letak sebenarnya dari titik-titik tersebut diatas di laut akan ditentukan dengan suatu care yang disetujui bersama oleh pejabat-pejabat yang berwenang clari kedua Pemerintah.

dalam ayat (3) untuk Republik Indonesia aclalah Direktur Baden Koordinasi Survey dan Pemetaan Nasional clan termasuk setiap orang yang dikuasakannya dan untuk Republik India adalah Ketua Hidrografi Pemerintah India dan termasuk setiap orang yang dikuasakannya.

PASAL II

Wiasing-masing Pemerintah akan berikhtiar dengan segala langkah-langkah yang perlu diclalam negeri guna memenuhi ketentuan-ketentuan clalam Persetujuan ini.

PASAL Ill

Apabila terclapat suatu struktur atau lapangan daripada minyak bumi atau gas clam, atau diposit mineral lainnya clari jenis apapun yang mel intasi garis batas tersebut dalam Pasal I, make kedua

Pemerintah akan soling menyampaikan semua keterangan mengenai hal ini dan akan berusaha mencapai persetujuan tentang care yang paling efektip untuk mengeksploitasi struktur, lapangan atau deposit dan keuntungan yang diperoleh dari pada eksploitasi tersebut akan dibagi secara adi I .

-PASAL IV

Setiap perselisihan antara kedua Pemerintah mengenai

penafsiran atau pelaksanaan Persetujuan ini akan diselesaikan secara clamai melalui konsultasi atau perundingan.

PASAL V

Persetujuan ini akan disyahkan sesuai dengan syarat-syarat ketatanegaraan Negara masing-masing. Persetujuan ini akan mulai berlaku pada tanggal pertukaran Piagam Pengesahan yang akan dilakukan secepat mungkin di NEW OEL-Wi •

AGREEMENT BETWEEN THE GOVERNMENT OF THE

REPUBLIC OF INDONESIA AND THE GOVERNMENT

OF THE REPUBLIC OF INDIA RELATING TO THE

DELIMITATION OF THE CONTINENTAL SHELF

BOUNDARY BETWEEN THE TWO COUNTRIES

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE

GOVERNMENT OF THE REPUBLIC OF INDIA,

DESIRING to strengthen the existing historical bonds of friendship

between the two countries,

AND DESI RI NG to establish the continental she If boundary between

the two countries,

HAVE AGREED as follows :

ARTICLE

(1)

The boundary of the Indonesian and the Indian continental

shelf in the area between Sumatra ( Indonesia ) and Great Nicobar

( India ) is the straight lines connecting Points 1 and 2, 2 and 3,

and 3 and 4. The coordinates of these Points are specified below :

The coordinates of the Points specified in clause (1) are

geographical coordinates and the straight lines connecting them are

indicated on

-(3) The actual location of the above-mentioned Points at sea shall be determined by a method to be mutually agreed upon by the competent authorities of the two Governments.

(4) For the purpose of clause (3), "competent authorities 11

in relation to the Republic of Indonesia means the Direktur Badon Koordinasi Survey den Pemetaan Nasional (Director of Coordinating Body for National Survey and lv\apping) and includes any person authorised by him, and in relation to the Republic of India means the Chief Hydrographer to the Government of India and includes any person authorised by him .

ARTICLE II

Each Government hereby undertakes to ensure that al I the necessary steps shall be taken at the domestic level to comply with the terms of this Agreement.

ARTICLE Ill

If any single geological petroleum or natural gas structure or field, or other mineral deposit of whatever character, extends across the boundary line referred to in Article I, the two

Governments shal I communicate to each other al I information in this regard and shal I seek to reach agreement as to the manner in which

-ARTICLE IV

Any dispute between the two Governments relating to the interpretation or implementation of this Agreement shall be settled peacefully by consultation or negotiation .

ARTICLE V

This Agreement shall be ratified in accordance with the constitutional requirements of each country . It shal I enter into force on the date of the exchange of the Instruments of Ratification which wil I take place at NEW DSt.. Hi as soon as possible.
