KERDJASAMA TEKNIK, ILMIAH DAN KEBUDAJAAN

BERHASRAT : Menana.mkan suatu dasar jang lebih kokoh untuk hul:ungan

persaudaraan antara Pemerintah dan bangsa masing-masing,

MEMPER.TIMB.ANGKAN: Kepentingan bersama dalam mempertinggi dan mengenbangkan ilmiah, teknologi dan kebudajaan mereka,

BERKEJAKINAN

MENGAKUI

Bahwa saling kerdjassma dilapangan teknik, ilmiah dan

kebudajaan akan memperbesar kemakmuran bangsa dan negara

ma sing-ma.sing, dan

: Bahwa keuntungan jang tidak terhingga dapa t ditjapii oleh kedua negara dari usaha jang berharga ini tentang kerdjasama

teknik, ilmiah clan kebudajaan, Pemerintah Republik Indonesia

dan Pemerintah Republik Demokrasi Rakja t Korea telah mentjapd persetudjuan sebagai berikut :

PASAL I

Kedua belah pihak

akan

berusaha mewudjudkan kerdjasama dan

saling membantu dalam batas-batas kesanggupannja dan kemungkinannja tentang persoalan-persoalan teknik, ilmiah dan kebudajaan dilapangan-lapangan jang mungkin dapat disetudjui oleh kedua belah pihak. Kerdjasama teknik, ilmiah

dan kebudajaan itu dilakukan atas dasar persamaan dan keuntungan bagi kedua.

PASAL

II

Untuk

melaksanakan persetudjuan kerdja sama teknik, ilmiah dan kebuda.jaan sebagai tersebut dalam pasal I diatas, usaha-usaha jang berikut

akan di laksanakan :

a. pertukaran tenaga teknik, tenaga-tenaga ahli dan penasehat-penasehat, b. bantuan timbal balik untuk tudjuan menetapkan luas lapangan pekerdjaan

jang timbul dari projek-projek j ang bersangkutan dengan rentjana-rentjana

pembangunan dari kedua negara,

o. pertukaran dokumen-dokumen teknik, ilmiah dan kebudajaan, termasuk pilem bioskop, bahan2 radio, buku2, madjalah2 dan lain2 penerbitan,

d. pertimba.ngan-pertimbangan timbal balik tentang persoalan-persoalan teknik, organisasi dan ketatalaksanaan,

e. pertuka.ran sardje.na, scientist dan mahasiswa2,

-f'. latihan praktis dalam perusahaan industri dan lanbaga-lemb98a teknik,

g. bersama-sama mEllgadakan peneii tian ilmiah serta penggunaannJa,

h. pertukaran rombongen2 kebudajaan, olahraga, wartawan dan lain2 ranboogan muhibah,

i. saling menga.dakan pameran2 kebudajaan, pendidikan dan perdagan&in,

j . bentuk-bentuk kerdjasa.ma lain dalam telmik, ilmiah <Um kebudajaan jang dapat disetudjui oleh kedua bele.h fihak.

PASAL III

Pelaksanaan usaha-usaha Jang ditjantumkan

dalam

pasal-pasal

sebelumnja akan dilaksanakan dengan djalan kontrak-kontrak atau

perdjandjian-perdjandjian jang terpisah, dibua t antara badan2 Indonesia dan Korea jang

sjah dalem bidang pemeri.ntahan maupW1 swasta dalam mana ditjan1mnkan lapangan den sjarat-sjarat kerdjasama.

PASAL r l

Pembajaran biaja jang bersangkutan dengan pelaksanaan kerdja

sama telmik, ilmiah dan kebudajaan jang ditetepkan dalam persetudjuan ini , akan diatur dalam kontrak-kontrak dan persetudjuan-persetudjuan tersendir:l

sebagai-mana tersebut dalam pasal III.

PASAL V

Sesuai dengan peraturan-peraturan clan hukum jang berlaku, kedua

pemerintah akan manberikan kepada v.arga negaranja masing-mesing jang diki.rimkan

kenegara bersangkutan berdasarka.n Persetudjuan ini, segala bantuan ｪ｡ｾ＠

dibutuhkan untuk memudahkan pekerdjaannja dan mendjamin berhasilnja pelaksanaan tugasnja.

PASAL VI

Ketentuan-ketentuan dalam Persetudjuan ini akan berlaku ｾｬ｡＠

terhadap orang-orang jang telah bekerdja pada waktu Persetudjuan ini berlaku

didaerah negara-negara jang bersangkutan dale.m rangka kerdjasama teknik jang telah diselenggarakan oleh kedua negara.

PASAL VII

Agar dapat menentukan hasil2 dari pelaksanaan persetudjuan ini

jang effektif', kedua belah pihak akan menindjau setjara berkala hasil-hasil da.ri kemadjuan dan persoalan dalam pelaksanaan Persetudjuan ini dan akan

kebudajaan ini.

PASAL VIII

Persetudjuan ini berla.ku untuk djangka waktu satu tah\Ul.

Djika salah satu Fihak tidak menberitahukan setjara tertulis niatnja

untuk mengachiri. Persetudjuan ini, tiga bulan sebelum berachirnja, maka

Persetudjuan ini dengan sendirinja dianggap sebagai diperpandjang setiap

kalinja untuk djangka waktu satu tahun.

Ketentuan-ketentuan jang diutaraka.n dalam Persetudjuan ini untuk sementara mulai berlaku pada hari ditenda-tanganinja.

Ketentuan-ketentuan itu akan berlaku sesungguhnja setelah di.adakan

pertukaran Nota antara kedua Pemeri.ntah dan akan tetap berlaku untuk djangka

waktu satu tahun sedjak tanggal pertukaran Nota.

Dibuat dan ditanda-tangani di Djakarta pada hari ke

dari Nopember

1963

aslinja dalam rangkap enam, masing2 dua dalam bahasa ｉｮ､ｾ＠ sia, Korea

dan Inggris, kesemuanja naskah adalah otentik dengan ketentuan bahvra djika

terdapat perbedaan penafsiran, naskah dalam bahasa Inggris akan diutamakan.

BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA

AND

THE GOVERNMENT OF THE DEllOCRATIC PBOPLE

DESIRING to establish

a

finner foundation for friendly relations between their

respective Govel'm!lents and peoples,

CONSIDERING their common interest

in the promotion and develo1&ent of their

science, technology

and

culture,

BELIEVING

that mutual cooperation

in

the field of technical,seientific and

cul-tUral

activities

will great'.cy'

enhance

the wel:t'are

of

their states and

peoples,

and

RECOGNIZING

the

immeasurable

benefits

to

be derived

by both

states

from this

worthy endeavour of closer technical, scientific and cultural cooperation. the

Government

of the Republic of Indonesia and the Government of'

the

Democratic

People• s

Republic

of Korea

have

agreed as

follows :

Article I.

The

Contracting

Parties shall

endeavour

to

cooperate

and

support each other,

within

the limits of their

capacities

and

possibilities,

in technical, scientific

and

cultural

problems in

fields that

may

mutually be

agreed upon.

Such technical,a.cienti:fic

and;

cultural. cooperation

shall

take

place

on a

basis

of

equal

partnership and

mutual benefit.

Article II.

In

order to implement the technical, scientific and cultural cooperation

agreement referred to

in

Article I above, the following activities

will

be

carried

out :

a. exchange of technicians, experts and

advisers ;

b.

mutual

assistance for

the purpose of assessing

the

scope of' work

deriTlng

frcm

projects

in

connection with development plans f'or

both

countries;

c. exchange of technical, scientific aDd cult\ll"Ql

dooumentation,in-clud.ing cinema films,

broadcasting

program,

books, periodicals

and

other

ｰｵ｢ｬｩ｣｡ｴｩｯｮｳｾ＠ _;J

d. mutual consultations regarding technical, organizational and

ma-nagerial

problems;

e. exchange of scholars, scientists

and

students;

f.

practical ••••••

industrial and

technical

irustitutions

and

enterprises;

g. joint scientific research and its applications;

h. exchange of cultural, sport, journalist groups

and

other

goodwill.

holding of cultural, educational

commercial

exhibitions

reciprocally;

j.

other forms of

technical, scientificanicultural cooperation upon

which

both Parties

may agree.

Article

III.

The implementation of the activities set forth in the preceding Artic1e

shall

be carrled out

through

contracts or

thr.:>ugh

separate agreements concluded

between appropriate Indonesian

and

Koreai

organs in the

governmental

as we1

as

in

the private sector,

in which

the

scope

and

tenns

of

mutua1

contribution

shall

be established.

Article

IV.

The payments of expenses incurred

in

carrying out of

the

technical,

scien-tific and cultural cooperation provided

in

the present Agreement

shall

be

esta-blished

in

each

individual case through contracts and agreement as mentioned in

Article III.

Article

v.

In

accordance

with the existing laws

am

regulations, both

Governments

shall

grant to

the citizens of either Contracting Country sent to the other under this

agreement,

all

assistance necessary to facilitate his work

and

assure

the

suc-cesf'ul performance

of his

task.

Article

VI.

The prov:i.Bions of this Agreement shall also apply to

all

persons who, upon

of this Agreement, are

active

in

territories of

the

Contract-ing Parties within the

framework of technical cooperation made available

by the

Goveronents of the Contracting Parties.

Article VII.

For the purpose of assessing the eff'ective implementation of this Agreement,

the

Contracting

Parties

shall undertake perlodic assessment of the progress and

problems of

the

implementation of this Agreement,

and shall

undertake such

mea-sures as

to maximiae the benefit that

may

be derived from

the

technical,

Article VIII.

This Agreement shall be valid for a period of one year.

In case neither of the Contracting Parties shall have given notice three

months

before

the expirations

of

said period

ot

its

intention

to

terminate

this Agreement, it will by

tacit

understanding be prolonpd each time tor

another period of one year.

The proviaions aet forth in this Agreement ahall ccme into :force

provisi-oJJall3 on

the

day

of the signing of this

Agreement.

They will definitely

cane into force atter an exchange of notes to

that

effect between

the

two Governments and

shall

remain in force for a period of

one

year.
