WHEREAS you are operating an industry in the name and style of M/s. Rain Cements Ltd., Unit – II, (Plant), Sreepuram, Boinacheruvupalli (V), Peapully (M), Kurnool District to produce Cement – 2.77 Million TPA inclusive of 1.94 Million TPA of Clinker production.
WHEREAS vide reference 1st cited, the Board issued closure orders to the industry as it has not complied with the directions issued by the Board and the SPM Values from the stack emissions have exceeded the standards.
WHEREAS vide reference 2nd cited, the industry has filed appeal in Hon’ble appellate authority vide Appeal No.31 of 2013. The Hon’ble appellate authority vide order dt:24.08.2013 has issued interim suspension of the impugned order for a period of three weeks. Subsequently, the Hon’ble appellate authority has extend the interim orders from time to time and final extension of interim suspension of closure orders was extended upto 05.07.2014 vide orders dt:07.06.2014.
WHEREAS the industry has filed writ petition in the Hon’ble High Court vide W.P.
No.18518 of 2014 to extend the interim orders of Hon’ble appellate authority in Appeal .No. 31 of 2013 and also staying the operation of closure orders dt:16.08.2013. The Hon’ble High Court vide order dt: 07/07/2014 has passed following order “Status quo as of today is to be maintained with regard to the functioning of the writ petitioner unit. To clarify it, in view of the interim order that was passed earlier by the appellate authority, writ petitioner unit was functioning and it will continue to function. This order will remain in force for a fortnight from date or till the appellate authority passes an order, whichever is earlier.” Subsequently, the Hon’ble High court vide order dt:15.07.2014 has passed following order: “interim order already passed will continue till the disposal of this matter”.

WHEREAS vide reference 3rd cited, the issue was reviewed in the Task Force Committee Meeting held on 19.02.2015. The representatives of the industry attend the hearing and informed that they are with drawing W.P.No.18518 of 2014. The committee after detailed discussion deferred the issue in view of the W.P.No.18518 of 2014.
WHEREAS vide reference 4th cited, the industry vide letter dt.14.09.2015 submitted that the Writ Petition pending before the Hon’ble High Court had been with drawn. The industry requested the Board to issue revocation of closure order and CFO order.
WHEREAS vide reference 5th cited, the Board officials inspected the industry on 28.10.2015 and issued notice to the industry on 19.12.2015 for un-authorized use of pet coke in the cement kiln and non-compliance of directions issued by the Board.
WHEREAS vide reference 6th cited, the industry submitted the reply to the notice, that they have stopped usage of Pet Coke in the cement kiln and complied the all directions.
WHEREAS vide reference 7th cited, the industry was reviewed in the Task Force Committee Meeting held on 18.02.2016 and issued revocation of closure order on 26.03.2016 with certain conditions.
WHEREAS vide reference 8th & 9th cited, the Board issued consent for operation and HW authorization order to the industry on 02.07.2016 and is valid upto 31.12.2019.
WHEREAS vide reference 10th cited, the Board officials inspected the industry on 24.09.2016 under randomized risk based inspection and observed the followings:
1. The industry has not provided storage shed for raw materials like Bauxite, Iron ore, Coal, Gypsum etc.,
2. The industry has to be ensured treatment of domestic effluents in STP.
3. The industry has provided continuous online stack emission monitoring systems for kiln & raw mill, coal mill, cement mill and cooler stacks for measuring SPM, SO2 and NOx are connected to APPCB website.
4. The industry is recovering heat energy and generating about 6.5 MW power with the same.
5. The industry is not generating process effluents. About 280 KLD of domestic effluents is being generated by the industry and township.
6. The industry is provided STP for treatment of domestic effluent is under up- gradation.
WHEREAS vide reference 11th cited, hearing was conducted before the External Advisory Committee (Task Force) Meeting of A.P.Pollution Control Board on 09.12.2016. The representatives of the industry attended the legal hearing. The committee noted the analysis reports of SPM values exceeding the Board standards and non-compliance of CFO order conditions and the directions of the Board. The representative of industry informed that at time of inspection, the damper of waste heat recovery Boiler was closed, so the values were exceeded. It was informed that they have already upgraded the STP in the month of September, 2016. They will construct the closed sheds by end of June’2017. It was also informed that they changed the CAAQM station near G-Type gate premises and will be completed by end of January’2017. The committee suggested that the industry shall take all pollution control measures to avoid the dust emissions in future and also instructed to calibrate online stack monitoring equipment and CAAQM stations in the presence of RO officials.
The Committee after detailed discussions, recommended to issue the following directions:
1. The industry shall provide closed sheds to store the raw materials within 6 months.
2. The industry shall continuously operate the water sprinklers at all the fugitive emissions sources to ensure compliance of Ambient Air Quality standards stipulated by the Board.
3. The industry shall take necessary measures to achieve the standard of 30 mg/Nm3 in the stack emissions as stipulated in the consent order dt.
02.07.2016.
4. The industry shall upgrade air pollution control equipment attached to cooler stack so as to achieve the standard stipulated by Board in the consent order dt.02.07.2016.
5. The industry has installed two CAAQM stations for measuring dust concentrations, one at School and another one at security entrance gate, which are falling on the South side of the industry and are totally away from the process area, raw material storage area and mining area. Hence, these CAAQM stations shall be shifted to East and West peripheries of the industry so as to cover predominant wind directions observed most of the year.
6. The industry shall ensure continuous compliance of the conditions issued in the CFO & HWA order.
This order is issued under Sec.33 (A) of Water (Prevention and Control of Pollution) Amendment Act, 1988 and under Sec.31 (A) of Air (Prevention & Control of Pollution) Amendment Act, 1987.
You are hereby directed to note that, should you violate any one of the directions mentioned above, action will be initiated under Sec.33(A) of Water (Prevention &
Control of Pollution) Amendment Act, 1988 and Sec.31(A) of Air (Prevention & Control of Pollution) Amendment Act, 1987 without any further notice, in the interest of Public Health and Environment.
This Order comes into effect from today i.e., 10.01.2017.
