To simplify the preparation of the tender documents for each tender, the PBDs groups the provisions intended to be used without modification in Part II. Care should be taken to ensure that the relevance of the provisions of the bidding documents is compared with the requirements of the specific works to be procured.

I NVITATION TO B ID

Cavite State University now invites bids for REPAIR AND IMPROVEMENT OF PHYSICS LABORATORY, INSTRUMENTATION ROOMS AND CHEMISTRY LABORATORY. The opening of bids will be held on October afternoon at the Function Hall, International House II, Cavite State University, Indang, Cavite.

I NSTRUCTIONS TO B IDDERS

A statement from the offeror's SLCC, which is similar to the contract to be offered, in accordance with clause 5.4 of the ITB. Unless otherwise specified in the BDS, payment of the contract price shall be made in Philippine pesos.

B ID D ATA S HEET

The name of the contract is REPAIR AND IMPROVEMENT OF PHYSICS LABORATORY, INSTRUMENTATION AND CHEMISTRY LABORATORY. The Government of the Philippines (GoP) through the Corporate Budget, in the amount of THREE MILLION TWO HUNDRED 30 THOUSAND SEVEN HUNDRED 47 PESOS &. For this purpose, similar contracts shall refer to contracts that have the same main categories of work.

The amount of not less than SIXTY FOUR THOUSAND SIX HUNDRED FOURTEEN PESOS & as bid security is in cash, cashier/manager check, bank draft/guarantee or irrevocable letter of credit;. The infrastructure project is packaged into a single lot and the lot will not be divided into sub-lots for the purpose of bidding, evaluation and contract award. 31.4(f) List additional contract documents relevant to the Project that may be required by existing laws and/or the Procuring Entity, such as construction schedule and S-curve, manpower schedule, construction methods, equipment usage schedule, construction safety and health program approved by the Department of Labor and Employment, and PERT/CPM or other acceptable tools of project scheduling.

G ENERAL C ONDITIONS OF C ONTRACT

All materials and plants at the site will be considered the property of the Procuring Entity. The Contractor shall comply with all instructions of the Procuring Entity Representative that are consistent with the laws in force where the Location is located. The performance guarantee will remain valid until the issuance by the Procuring Entity of the Final Acceptance Certificate.

All drawings prepared by the contractor for the execution of temporary works must be pre-approved by the client's representative before use. The approval of the client's representative does not change the contractor's responsibility for planning the temporary works. The contractor obtains the consent of third parties for the planning of temporary works, if requested by the client.

Each completed form will be verified and signed by the Procuring Entity's representative within two days of the work being done. The Procuring Entity's Representative's approval of the Work Program will not change the Contractor's obligations. The Contractor shall submit monthly statements of the estimated value of the work performed less the cumulative amount previously certified to the Procuring Entity's Representative.

S PECIAL C ONDITIONS OF C ONTRACT

NOTE: The duration of the contract will be calculated from the start date and not from the effective date of the contract. NOTE: The commencement date will be the date of receipt of the Notice to Proceed. NOTE: The names of key personnel and their designation will be completed by the winning contractor before signing the contract.

7.4. In the case of permanent structures, such as Type 4 and 5 buildings classified under the National Building Code of the Philippines and other steel, iron or concrete structures conforming to the relevant structural codes (e.g. DPWH Standard Specifications) , such as, but not limited to, steel/concrete bridges, overpasses, aircraft taxiways, ports, dams, tunnels, filtration and treatment plants, sewage systems, power plants, transmission and communication towers, railway system and other similar permanent structures: Fifteen (15) years. In the case of semi-permanent structures, such as buildings of types 1, 2 and 3 classified under the National Building Code of the Philippines, concrete/asphalt roads, concrete river control, drainage, irrigation canals, river landings, deep wells, rock causeways, pedestrian overpasses and other similar semi-permanent structures: Five (5) years.

S PECIFICATIONS

Representative at least twenty-eight (28) days before the date on which the Contractor seeks the consent of the Representative of the Contracting Authority. If the contracting authority's representative determines that such proposed deviations do not guarantee substantially equal or higher quality, the contractor shall comply with the standards specified in the documents. A signature box shall be added at the bottom of each page of the Quantity Book where the Bidder's authorized representative shall affix his signature. Failure of the authorized representative to sign each page of the submission will be grounds for rejection of his bid. Unless otherwise stated in the BDS, the Bidder may subcontract portions of the Works to the extent approved by the Contracting Entity and stated in the BDS. In the event that a subcontractor is not considered eligible by the contracting authority, the outsourcing of such part of the work will not be permitted.

The ranking of the total bid prices as thus calculated from low to high. Failure to timely submit any of the post-qualification requirements, or a finding that contradicts their veracity, will disqualify the Bidder from award. A negative decision will result in the rejection of the Bidder's bid, in which case the Contracting Authority will proceed to the next Lowest Calculated Bid, with a further period to make a similar determination of that Bidder's capabilities to perform satisfactorily.

In case of disapproval, which must be based on valid, reasonable and justifiable reasons as provided in Section 41 of the IRR of RA 9184, the HoPE shall notify the BAC and the bidder in writing of such decision and the reasons thereof. . When applicable, the BAC will conduct post-qualification of the bidder with the next lowest calculated bid. A request for reconsideration may be filed by the bidder with the HoPE pursuant to Section 37.1.3 of IRR RA 9184.

The date of completion shall be the date of completion of the works as certified by the representative of the contracting entity in accordance with GCC Clause 49. From the Commencement Date until the Certificate of Final Acceptance is issued, the following risks are of the Procuring Entity:. a). The Procuring Entity will terminate this contract for non-payment when any of the following conditions attend its implementation:. In the event of the Contractor's insolvency, any Contractor's Equipment that the Procuring Entity instructs in the notice must be used until the completion of the Works;.

All decisions recommended by the CTRC are subject to the approval of the HoPE. In the absence of the CPES assessment sheet, the existing performance monitoring system of the contracting authority will be applied. The representative of the contracting entity may require the contractor to provide an estimate of the expected effect of the future event or circumstance on the contract price and completion date.

The first installment payment may be made by the Client to the Contractor provided that at least twenty percent (20%) of the work has been completed, as certified by the Client's representative. After the completion of the entire works, the contractor can replace the retained money with a bank guarantee "on demand" in a form acceptable to the client.
