Description: The Development Application is for the demolition of existing structures and the construction of a shopping centre with associated signage. The proposed shopping centre will be 2 storeys in height and will include 8,026.55sqm of commercial gross floor area. The shopping centre will include a Woolworths Supermarket, 5 specialty stores including BWS Liquor, a Medical Centre, Child Care Centre and 2 office premises. The proposed shopping centre will include at grade and upper level car park comprising 334 car parking spaces.

Council received Gateway Determination on 2 November 2016 to proceed with a planning proposal 6 McCausland Place, Kellyville (formerly known as 4 McCausland Place, Kellyville). The planning proposal will facilitate the development of a residential flat building comprising of 20 units on the south east corner and 15 townhouses on the remainder of the site.

The key amendments to The Hills Local Environmental Plan 2012 (LEP 2012) include:

• To add a new clause in Schedule 1 – Additional Permitted Uses to permit ‘residential flat buildings’ with a maximum of 20 units;

• Increase the maximum building height to 14 metres for the portion of land where residential flat buildings will be located; and

• Apply a maximum floor space ratio of 1.6:1 where the residential flat building will be located.

PlaNNiNg PRoPosal aND assoCiaTED DRafT voluNTaRy PlaNNiNg agREEMENT aT 28 faiRway DRivE, KEllyvillE (6/2016/PlP)

Council received Gateway Determination on 2 November 2016 to proceed with a Planning Proposal at 28 Fairway Drive, Kellyville. The amendments will facilitate development on the site of a greater residential density than permissible under the current controls. The planning proposal will allow for up to 213 dwellings (being 134 more dwellings than currently approved) on the western portion of the site in buildings up to 12 storeys in height.

The key amendments to The Hills Local Environmental Plan 2012 include:

• Increase the maximum building height applicable to the western portion of the site (west of the drainage corridor) from 16 metres (up to 5 storeys) to 36 metres (up to 12 storeys); and

• Apply a ‘base floor space ratio’ of 1:1 and an ‘incentivised floor space ratio’ of 3:1 to the western portion of the site (west of the drainage corridor).

Delegation for making of the LEP has been issued to Council under the Gateway Determination.

In addition to the above, the applicant has submitted a draft Voluntary Planning Agreement (VPA) which addresses additional demand for local infrastructure generated by the increased residential yield on 28 Fairway Drive, Kellyville.

The draft VPA secures a monetary contribution towards the provision of new local infrastructure which addresses the additional demand generated by the increased residential development yield on the land. This monetary contribution is in addition to the Section 94 contributions payable in association with development already approved on the western portion of the site (west of the drainage corridor).

The LEP amendments and draft VPA are now on exhibition and available for inspection at the following locations:
