All construction work must be carried out in accordance with the provisions of the Building Code of Australia. Before demolition works can begin, a pre-demolition inspection must be arranged with the Council's development certification team.

Roads and Maritime

The curb and gutter design and construction on Windsor Road must be in accordance with road and shipping requirements. A plan control fee (amount to be specified) and the submission of a performance bond may be required from the applicant before the approved road design plans are released by Roads and Maritime.

Adherence to Waste Management Plan

Details of these requirements should be obtained from Roads and Maritime Services, Manager Developer Works, Statewide Delivery, Parramatta (telephone 9598 7798). Detailed design plans of the proposed gutter crossing must be submitted to Roads and Maritime for approval prior to the issue of a Construction Certificate and the commencement of any roadworks.

Commencement of Domestic Waste Service

The redundant driveway on the Windsor Road boundary will be removed and replaced with a curb and gutter to match the existing one.

If the engineering works included in the scope of this approval extend onto adjacent land, the written consent of all affected adjacent property owners must be obtained and submitted to the Chief Approving Authority prior to the issuance of a building permit. The site in question must be subject to a restriction that prevents access to Windsor Road using the terms "restricted access" included in the standard recitals. The subject site must be burdened with a restriction on the use of the terms "number of bedrooms" included in the standard opening statements.

A MOTION WAS MADE BY COUNCIL THOMAS AND CARRIED BY COUNCIL PRESTON that the recommendation contained in the report be adopted. A PROPOSAL WAS CONSIDERED BY RÅDMANN HASELDEN AND ISSUED BY RÅDMANN PRESTON that the recommendation in the report should be adopted.

Development in Accordance with Submitted Plans

The applicant must provide the Council with written evidence at least four weeks before the due date notice that the matters listed in Section A1 above have been satisfactorily addressed. Clear and accurate external directional signage should be placed on site at driveway entry points and on buildings. Unit numbering signage is also required on stairwell access doors and elevator/lobby entrance doors.

Therefore, if the proposed development under DA1667/2016/HA is amended to become one strata with this application, the plans must be resubmitted to the Land Information Section of the Council to be renumbered. It is essential that all license plates throughout the complex are clear to help emergency services find a destination easily and quickly.

All unused landings and paths should be removed and replaced with curb and gutter along with restoration and turfing of the adjacent path edge area. A 1.2m wide concrete footpath including access ramps at all junctions shall be provided along the road frontage of the development area crossing the adjacent existing footpath in accordance with the above documents.

Rain Garden and Rainwater Reuse Tank

Grading, trimming, topsoil and turfing of the footpath edge in front of the development site is required to ensure a slope of between 2% and 4% falling from the boundary to the top of the curb. Before paying the above contribution, the applicant is advised to contact the Council's development contribution officer on 9843 0268.

Internal Pavement Structural Design Certification

The following monetary contribution is payable to the Council in accordance with section 94 of the Environmental Planning and Assessment Act, 1979, to meet the increased demand for public facilities and services resulting from the development. Council Contribution Plans can be viewed at www.thehills.nsw.gov.au or a copy can be inspected or purchased from the Council Administration Centre.

A Section 73 Compliance Certificate in terms of the Sydney Water Act 1994 must be obtained from Sydney Water Corporation. The Section 73 certificate must be submitted to the Chief Certifying Authority prior to occupation of the development/release of the subdivision plan.

On receipt of the Auditor's written Report:-. a) the financial statements are advertised and sent to the NSW Office of Local Government;. Council resolves to pay the Audit Office NSW a total of $80,000 for FY17, which is equal to the cost of the FY16 audit.

Compliance with the Planning Agreement will be achieved for the residential plots after registration of the subdivision and the removal of the record of the Planning Agreement from those plots is supported.

Lot 641 DP 1202060 (Roland Garros Circuit, Kellyville)

The release of the Positive Covenant will allow the new Asset Protection Zone to be created further east, closer to the actual wildfire threat. The positive covenant is released by acting concurrently with the allotment plan creating the replacement asset protection zone (DA 294/2016/ZD).

Council is the authority that has the rights to release the positive covenant and the restriction on the use of the land.

Compliance with the Planning Agreement is required by the conditions imposed on any development consent. The Planning Agreement registration on the title of those lots will not be removed.

NORTH KELLYVILLE

In addition, community groups on social media platforms such as Facebook use the name North Kellyville. Given the long-standing use and community association with the name 'North Kellyville', it is considered reasonable for the Geographical Names Board to make an exception to their guidelines.

NORWEST

Concerns were also raised during community consultation about the inclusion of the Sisters of Saint Joseph site in the new Norwest suburb due to its historic value and long association with the suburb of Baulkham Hills. The change will also enable the boundary between Norwest and Baulkham Hills to be more easily identified and interpreted by the community and will maintain the connection of the heritage site to the outskirts of Baulkham Hills as raised in submissions to the previous proposal.

BELLA VISTA EXTENSION

The proposed extension of the Bella Vista suburb boundary east to the Balmoral Road Reserve boundary is considered a logical extension of the suburb as all residential developments along Gardenview Court could be located in the same suburb. It is believed that using Balmoral Road Reserve as part of the suburb boundary will better meet these requirements.

REVISED PROPOSAL

As discussed above, the proposed amendment of Norwest's southern boundary to follow Barina Downs Road, rather than the rear property boundary, will be more appropriate for treatment purposes, and the proposed extension of Bella Vista to the Balmoral Road reserve boundary will provide a logical extension of the suburb of Bella Vista. In accordance with the Integrated Planning and Reporting Guidelines, all councils are required to prepare an end-of-term report (Attachment 1) on progress in implementing the Community Strategic Plan "Hills Future".

One of the achievements of which I am most proud of this Council mandate is the leadership of the Transitional Housing Policy Framework. I have no doubt that this policy will make history and that it will ultimately change the lives and futures of the most vulnerable people in our community.

MAYOR’S MESSAGE

Throughout the planning and construction stages of the new railway, the Council's aim has been to ensure that residents have the right mix of housing, jobs and transport options. While our new railway is under construction, the Shire's building approvals are booming and provide an excellent indicator of the positive economic activity, employment and investment opportunities available.

COUNCILLOR REFLECTIONS

PROACTIVE LEADERSHIP

THE COUNCIL MOVED TO NEW PREMISES IN NORWEST BUSINESS PARK TO MAKE WAY FOR SYDNEY METRO NORTHWEST IN 2013. The move cleared the way for the construction of Sydney Metro Northwest's Showground Station (with the land compulsorily acquired by the NSW Government).

Two new contribution plans have been adopted for Box Hill Precinct and Box Hill North Precinct to provide funding and delivery of $631 million for local parks, playgrounds, road upgrades, water management works and community facilities. The subdivision of the Box Hill and Box Hill North ("The Gables") relaxation areas has progressed rapidly with significant introductory infrastructure in place and the construction of the first dwelling.

Installation of a 99 KW solar system in the administration building, which produces 7% of the building's energy needs, reducing dependence on the electricity grid.

ENVIRONMENT

Supported the fridge buyback scheme which saw over 3,990 fridges and freezers collected by residents in The Hills, saving over $1 million in electricity and recycling over 350 tonnes of metal. Sponsored the annual Garage Sale Trail event for the community to come together, host a garage sale and celebrate the importance of reuse.

WASTE CONTRACT

They organized the annual Household Chemical CleanOut events, in which more than 7,500 residents participated and safely disposed of more than 328 tons of household chemicals.

Directed the Sydney Hills Lunar Festival at North Rocks Park, resulting in a huge success with over 7,000 people in attendance throughout the event. Hosted The Hills Building & Design Awards, which resulted in a record number of entries.

ORANGE BLOSSOM SUMMER

Embarked on a joint initiative between The Hills Shire Council and The Hills Youth Ambassadors which saw 45 members (children aged 8 – 14 years) join the first Sydney Hills Youth Choir. Attracted thousands of residents annually to the Orange Blossom Festival, one of the most popular festivals in The Hills.

MODERN LOCAL ECONOMY CONTINUED

During the mandate, the NSW Government continued its interim funding arrangements for "capped contributions" under section 94 of the Environmental Planning and Assessment Act. With the challenges of planning and servicing new communities, and with a budget constrained by rate-fixing, The Hills Shire also faced the ongoing issue of the cost of maintaining The Shire's existing infrastructure.

KEY CHALLENGES

The council created the Hills Corridor Strategy - a plan that creates a vision for the Sydney Hills of the future. Council continued to work with the NSW Department of Planning and Environment on the North West Growth Priority Area Plan.

Where to next?

This will ensure that it is valued, maintained and improved through effective stormwater and environmental sustainability projects, as well as litter, recycling and curbside services.

Castle Hill

QIC's contribution would enable the installation of the giant Christmas tree which has been a feature for the past three Christmases'. As part of the Christmas Sky show held for the past 3 years, the Council co-ordinated pre-show entertainment involving community music schools allowing the children to perform for the public.

Norwest Lake

An installation of the giant Christmas tree could be completed by coordinating similar entertainment for each evening in December until Christmas Eve. Performances could be held on the council pavement next to the Christmas tree outside the Piazza.

Rouse Hill

The Rouse Hill Town Center proposal must be exhibited for 28 days under the provisions of s356 of the Local Government Act as it proposes to contribute financial assistance to the GPT for the purpose of removing the Council's Christmas activities. This report has been prepared in accordance with Section 121ZD of the Environmental Planning and Assessment Act 1979 (EP&A Act) following an inspection by Fire & Rescue NSW (FRNSW) of the building located at 97 Caddies Boulevard, Rouse Hill.

Statutory Consideration

04/08/2017 Received FRNSW inspection report raising concerns about the level of fire safety in the building. 17/08/2017 Notice of Intent to Issue a Fire Safety Order to the Owners Strataplan No.

Fire safety issues and recommendations specified in Fire & Rescue NSW inspection report

The Board must consider the inspection report of FRNSW and determine whether it is appropriate to serve an Order Number 6 in terms of Section 121B of the EP&A Act. FRNSW therefore awaits the Council's advice on its determination in accordance with Section 121ZD (4) of the EP&A Act.

Inspection by Council’s Fire Safety Officers

FRNSW's subsequent inspection report was limited to a visual inspection of the essential fire safety measures in parts of the building that were being entered at the time of the inspection. The inspection revealed a number of fire safety deficiencies in the building related to the fire hydrant system, sprinkler system, longer travel distances from single-person units to an exit, the lack of portable fire extinguishers, and problems with signage, including a failure to provide block plans.

External Cladding

This may include but is not limited to a copy of the product's Certificate of Conformity/. Certificate of Accreditation, report from a Registered Testing Authority, certification confirming product delivery on site and certification confirming product installation.

Conduct of certifier

A letter was sent to the property owners to raise awareness of the combustible cladding issue and request that they review all design, construction and approval documents to determine that the exterior cladding materials installed on the building comply with the Building Code of Australia complies. A letter was also sent to the Chief Certifying Authority requesting a copy of all documentation relied upon to determine that the external cladding material installed complies with the Building Code of Australia.
