MEMORANDUM SALING PENGERTIAN ANTARA

PEMERINTAH REPUBLIK INDONESIA DAN

PEMERINTAH REPUBLIK SOSIALIS VIETNAM MENGENAI

KERJASAMA DI BIDANG PARIWISATA

Menun j uk Persetujuan Kerjasama dibidang Ekonomi, Pen get ahuan dan Tehni k d i ant ara kedua Pi hak yang d i t a nd at an gan i di Hanoi pada tanggal 21 Nopember 1990;

Berhasrat untuk memperkokoh hubungan persahabatan yang telah ada melalui pengembang an kepariwisataan di antara kedua negara;

Sesuai deng an hukum dan perundang-undangan yang berlaku bagi ked ua Piha k.

PASAL 1 TUJUAN KERJASAMA

Memoran du m Saling Pengertian ini bertujuan untuk

a. Men ingkatk a n jumlah kedatangan wisatawan ke kedua negara dari pasar an wisata dunia, melalui Republik Indonesia dan I at au me la lui Republik Sosialis Vietnam;

b. Men do rong jumlah penyebaran pengunjung-pengunjung yang

l ebi h luas ke berbagai daerah tujuan wisata dan atraksi-atraksi di masing-masing negara;

Men dorong penduduk

kunjungan-kunjungan dar i para warganegara dan kedua negara ke masing-maing negara; dan

PASAL 2

RUANG LINGKUP KEKUASAAN

Para Pihak berse pakat untuk terjalinnya kerjasama yang erat dibidang yang menyangkut masalah kepariwisataan, melalui badan resmi se 1 aku pe 1 aksana dari Memorandum Sa 1 i ng Pengert ian ini . Dar i Pihak Indonesia adalah Direktorat Jenderal Pariwisata, Dep ar temen Par iwisata, Pos dan Telekomunikasi dan untuk Vietnam a dalah Ba dan Adm i nistrasi Pariwisata Nasional Vietnam.

PASAL 3

BIDANG-BI DANG KERJASAMA

Kedua Pi hak akan berupaya unt uk memaj ukan ker j asama pari wi sat a sesuai dengan huk um dan perundang-undangan yang berlaku di kedua negara, d i bid an g-bidang sebagai berikut

a. PENELITIAN DAN PENGEMBANGAN

Kerjasam a di bidang penelitian dan pengembangan dilaksanakan me l a lui pe rtukaran informasi dan dengan melaksanakan studi penelitian dalam bidang-bidang yang bermanfaat bagi kedua Pih ak .

b . PEND IDIKAN DAN PELATIHAN

Kerjasama dibid an g pendidikan dan pelatihan dilaksanakan melalui per tukaran informasi, studi-studi perbandingan mengenai program-program pelatihan dan peningkatan keahlian pada kedu a sektor di kalangan pemerintah maupun swasta .

c . PROMOSI

(I) Di bid an g promosi, kedua Pihak akan bekerjasama untuk menyebarl uas ka n bahan-bahan promosi pariwisata dari masing-masing negara kepada ne gara-negara lain .

(II) Ked ua Pi hak ak a n be ke rjas ama untuk meningkatkan arus wi sa t awan melalui ud ara maupun melalui laut antara kedua negara dan akan be rusaha member i kan kemudahan pe 1 ayanan ya ng be rhubung a n dengan hal tersebut .

d . PERTEMUAN INSENTIF, KONVENSI DAN EKSIBISI

Kerjasama di bi dan g-bid a ng pe r temuan, insentif, konvensi dan e ksibis i a kan dilaks a nakan melalui pertukaran program-p rogram ant ar ke dua negara.

e . PROMOSI REGIONAL

Promos i pari wisata di tingkat regional akan ditingkatkan di se1 uruh wilayah Republik Indonesia dan Repub1ik Sosia1is Vietnam sesuai dengan hukum dan perundang-undangan yang berlaku di negara masing-masing.

f. KERJASAMA SEKTOR SWASTA

PASAL 6

PERUBAHAN-PERUBAHAN

Memorandum Saling Pengertian ini dapat dirubah atau diperbaiki . Sa 1 a h sat u Pi hak dapat memi nt a peru bah an at au pe rba i kan secara t ertu li s . Setiap perubahan yang telah disetujui oleh kedua Pihak sesuai den gan hukum dan perundang-undangan yang berlaku di kedua Pihak akan merupakan bagian dari Memorandum Saling Pengert ian ini . Tangg al be rlakunya perubahan atau perbaikan tersebut dit entukan ol eh kedua Pihak .

PASAL 7 MULA! BERLAKU

Memo ran dum Saling Pengertian ini akan mulai berlaku pada tanggal pen andatangana nnya.

PASAL 8 MASA BERLAKU

a. Memorand um Saling Pengertian ini akan berlaku untuk jangka wa ktu lima (5) tahun dan selanjutnya diperpanjang be rturut-turut selama lima (5) tahun kecuali dibatalkan seca r a tertulis oleh salah satu Pihak enam (6) bulan sebe lumny a .

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA

AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM ON COOPERATION IN TOURISM

The Government of the Government o f t he Soc iali s t referr ed to as t he "Parties");

Republic of Repub 1 i c of

Indo nesia and the Vietnam (hereinafter

Referring to the Agreement on Economic and Scientific and Tehnical Cooperation bertwe e n the Parties signed in Hanoi, on November 21, 1990;

Desi ring to strengthen the e xisting friendly relations thro ugh th e de velopmen t of touri s m be t we en the two Countries ;

Pursuant to th e preva i 1 i ng 1 aws and regu 1 at ions of the Parties .

HAVE AGR EED a s f o llows :

ARTICLE 1 AIMS OF COOPERATION

This Memorandum of Un der standing aims to:

a . I ncre a se touri st arrivals to both countries from world to u ri st gener ating markets, t hr ough the Socialist Republic of Viet nam an d/or through the Republic of Indones i a;

b. En c ou ra ge a wider distribution of visitors to the various t ouri st destinations and attracti ons in each other's count ry ;

c . En courag e visits of bo th na tionals and residents to each oth er 's co untry; a nd

ARTICLE 2 FIELD OF AUTHOR ITY

Th e Parties ar e commit t ed to keep c lose r elations as r egards t he t our i sm fi eld , through t hei r c ompeten t off ici al agencie s which wi ll be t he executi v e o f this Memorandum . I n t his connect ion , t he off i cia l agency f or t he Socialist Republic of Vietnam is the Vietnam Nationa l Admi nistrat ion of Tourism and for the Re pub lic o f Indonesia i s t he Directorate General o f Tourism, Departme nt of Tourism , Pos t and Telecommunication .

ARTICLE 3

AREAS OF COOPERATION

Both Par ti es wi ll endeavou r t<? promote t ourism cooperation in accordance with t he l aw s and r egulations o f t heir count ri es in t he f ollowin g areas :

a . RESEARCH AND DEVELOPMENT

Cooperation in th e area of research and dev el opment t hroug h e xchang e of i nformat i on and r esearch. studies in areas t hat will benefi t both Part ies .

b. EDUCATION AND TRAINING

Cooperation i n the a re a of education and t raining wi 1 1 be undertaken th rough exchange of information , comparative s tudies on t raining programmes and skills i mprovemen t in bot h pub lic and th e pri vat e s ectors .

c. PROMOTION

I) In t he areas of promot i on, both Parties wi ll cooperate in disseminat i ng t ourist promotion material s of each c ountr y t o the o ther countries .

-II) The Pa rties s hall promote the tourist flows by air and se a bet ween both countries and shall endeavour to seek the sup ply o f esse nti a l serv i ces for that purpose.

d . ME ETING, I NCENTIVES, CONVENTIONS AND EXHIBITIONS Cooperat ion

The coop e ration in the a re as of tourism between the r es pe c t ive pri vate sectors of both countries will be further enco urag ed an d stren gthened .

ARTICLE 4 IMPLEMENTATION

a. Bot h Parti es will hold consultations as deemed necessary in i mp l emen ti ng this Memorandum of Understanding .

b. To fa c ilitate t he implementation of this Memorandum of Unders t and ing both Parties will set down the procedur es , p 1 a ns and r ecommend programmes of cooperation toward ach ievin g it s a i ms.

c . The Parti es sh all make use of the exiting Joint Commission as mentioned in the Article 3 of the 1990 Agreement on Econom ic, Sc i entific and Technical Cooperation in carrying out th i s Memo ra ndum of Un de rs tanding.

SETTLEMENT OF DISPUTES

AMENDMENTS

This Memorandum of Understanding c an be amended or rev i s ed . Either Part y may r equest i n wri t in g a r evision or amendmen t. An y amendmen t or r evi s ion agreed t o by both Par t i es in comfo rmity wit h t he 1 aws an d r egu 1 a t ions of t he Pa rtie s sh a 11 form pa r t of t his Memo ran dum of Underst andi ng. Suc h revi si on or amendme nt sha l l come i nto effec t on suc h a date as ma y be d ete rm ine d b y bot h Parties .
