DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 640/MPP/Kep/9/2002
ON
THE TEAM FOR CONTROLLING THE EXPORT VOLUME OF SEA SAND
THE MINISTER
Considering :
In connection with the issuance of Decree of the Minister of Industry and Trade No. 598/MPP/Kep/8/2002 on the stipulation of volume of sea sand which can be exported in 2002, it is necessary to issue a decree of the Minister of Industry and Trade on the establishment of the team for controlling the export volume of sea sand;
In view of :
1. Presidential Decree No. 260/1967 on the affirmation of tasks and responsibility of the Minister of Trade in the foreign trade sector;
2. Presidential Decree No. 228/M/2001 on the establishment of the Mutual Cooperation Cabinet;
3. Presidential Decree No. 102/2001 on the status, tasks, functions, organizational structures and working arrangements of ministries;
4. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries; 5. Presidential Decree No. 33/2002 on control and supervision over exploitation of sea sand;
6. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on export general provisions as already amended several times and the latest by Decree of the Minister of Industry and Trade No. 575/MPP/Kep/VIII/2002;
7. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
8. Decree of the Minister of Industry and Trade No. 441/MPP/Kep/5/2002 on sea-sand export provisions; 9. Decree of the Minister of Marina and Fishery as the Chairman of the Team for Controlling and Supervising
Exploitation of Sea Sand No. 01/K-TP4L/VIII/2002 on guidance for controlling and supervising exploitation of sea sand;
10. Decree of the Minister of Marina and Fishery No. KEP.33/MEN/2002 on the zoning of coastal and sea territories for activities of exploitation of sea sand;
11. Decree of the Minister of Industry and Trade No. 598/MPP/Kep/8/2002 on stipulation of the volume of sea sand which can be exported in 2002.
DECIDES :
To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE TEAM FOR CONTROLLING THE EXPORT VOLUME OF SEA SAND.
Article 1
The composition of the Team for Controlling the Export Volume of Sea Sand shall be as follows :
Chairman : The Governor of Riau Province
Secretary : The Head of Industrial and Trading Service of Riau Province
2. The Regent of Riau Island or the appointed official 3. The Regent of Bengkalis or the appointed official 4. The Mayor of Batam or the appointed official
5. Representative of the Directorate General of Foreign Trade 6. Representative of the Indonesian Police/Provincial Police 7. Representative of the Indonesian Military/Guskomla Armabar
8. Representative of the Directorate General of Marine and Fishery Resource Control, Ministry of Marine and Fishery
9. Representative of the Directorate General of Customs and Excise/Regional Office of the Directorate General of Customs and Excise
10.Representative of the Riau Governor Office
Article 2
The Team for Controlling the Export Volume of Sea sand as meant in Article 1 shall be domiciled in Pekanbaru, Riau.
Article 3
The Team for Controlling the Export Volume of Sea Sand shall be assigned :
(1) to verify and cross check data conveyed by surveyors, related to applications of Sea Sand Exporters (EPL) owning allocation of sea sand volume for securing export approval.
(2) to issue ratification in the form of approval or rejection of applications of EPL to export sea sand, on the basis of results of the verification and cross check as meant in paragraph (1).
(3) to convey ratification of the approval or rejection as meant in paragraph (1) to surveyors later forwarding them to the governor and/or regents/mayors or officials authorized to issue approval of export sea sand.
Article 4
The Team for Controlling the Export Volume of Sea Sand shall convey report on it activities on a monthly basis to the Minister of Industry and Trade and the Chairman of TP4L.
Article 5
All costs needed for implementing this decree shall be borne by the State Budget of Revenue and Expenditure as well as the Regional Budget of revenue and Expenditure.
Article 6
This decree shall come into force as from the date of stipulation.
For public cognizance, this decree shall be announced by placing it in State Gazette of the Republic of Indonesia.
