MINISTER OF INDUSTRY AND TRADE THE REPUBLIC OF INDONESIA
NUMBER: 436/MPP/Kep/7/2004 REGARDING
STIPULATION OF STANDARD PRICE
USED FOR DETERMINING RESOURCES ROYALTY PROVISION OF WOOD AND RATTAN
MINISTER OF INDUSTRY AND TRADE THE REPUBLIC OF INDONESIA
Considering:
a. That term of validity of standard price used for calculating Resource Royalty Provision for Wood and Rattan, as set forth in Decree of Minister of Industry and Trade Number 444/MPP/Kep/6/2003 which is an implementation of article 3 of Government Regulation number 59 Year 1998 regarding Tariff on Non-Tax State Revenue as amended with Government Regulation number 74 Year 1999,has expired, therefore it is necessary to re-stipulate the said standard price.
b. Therefore it is deemed necessary to issue Decree of Minister of Industry and Trade.
In View Of:
1. Government Regulation of The Republic of Indonesia Number 51 Year 1998 regarding Resources Royalty Provision(State Gazette Year 1988 Number 84 additional to State Gazette Number 3759); 2. Government Regulation of The Republic of Indonesia Number 59 Year 1998 regarding Tariff of
Non-Tax State Revenue Applied at Ministry of Forestry and Plantation (State Gazette Year 1988 Number 94, Additional to State Gazette Number 3767) as amended with Government Regulation of The Republic of Indonesia Number 74 Year 1999 (State Gazette Year 1999 Number 137);
3. Presidential Decree of The Republic of Indonesia Number 260 Year 1967 regarding Duty and Responsibility of Minister of Trade in Foreign Trade Affairs;
4. Presidential Decree of The Republic of Indonesia Number 228/M Year 2001 regarding the Formation of The Gotong Royong Cabinet;
5. Presidential Decree of The Republic of Indonesia Number 102 Year 2001 regarding Title, Task, Function, Authority, Structure, Organization and Working Procedure of Ministry;
6. Presidential Decree of The Republic of Indonesia Number 109 Year 2001 regarding Organization Unit and Task of Echelon I Ministry;
7. Decree of Minister of Industry and Trade of The Republic Of Indonesia Number 86/MPP/Kep/3/2001 Organization, Working Procedure at Ministry of Industry and Trade.
Considering:
Result of meeting attended by interdepartmental institutions and associations held on June 2004 regarding Standard Price for Determining Resources Royalty Provision.
Decide Stipulate:
DECREE Of MINISTER OF INDUSTRY AND TRADE OF THE REPUBLIC OF INDONESIA NUMBER: 436/MPP/Kep/7/2004 REGARDING STIPULATION OF STANDARD PRICE USED FOR DETERMINING RESOURCES ROYALTY PROVISION OF WOOD AND RATTAN.
(1) Resources Royalty Provision abbreviated as (PSDH) is a fee paid as a substitute of intrinsic value of resources taken from state forest.
(2) The value of Standard Price used for determining PSDH shall be stated based on weighted average market price of forestry resources on domestic and foreign market.
Article 2
(1) The value of Standard Price for determining PSDH of Wood and Rattan is as mentioned in the appendix of this decree.
(2) The Standard Price referred to in paragraph (1) is effective from the date of the stipulation of this decree until 31 December 2004.
Article 3
(1) The value of Standard Price used for determining PSDH from July 1 until the date of the stipulation of this decree shall be based on Decree of Minister of Industry and Trade Number 444/MPP/Kep/6/2003.
(2) In the event the standard price as stated in this decree has expired and the new standard price has not been stipulated, the standard price as stated in this decree shall continue to apply until the stipulation of the new standard price.
Article 4
This decree shall come into force on the date of stipulation.
For everybody to be aware of it, this decree is ordered to be announced by placing it in the State Gazette of the Republic of Indonesia.
