ASSESSMENT FINDINGS

Summary of Assessment Report of the RSPO Certification

During the audit it was found that the company has no restrictions on the document published on the estate, unless they are prevented by management confidentiality or disclosure of information that could lead to negative results for the company. At estate and employee levels, management has been trained by management to provide the information to all levels and staff activities. The documents made available in the estate included: .. i) Title and right of use of the land; the document was made available to the estate management office and based on the interview the management had demonstrated that they have a legal right to respected land (see 2.2.1). ii) Safety, Health and Environment: Documents are available on each estate.

The company had provided the risk assessment and mitigation plan, including training, accident and its records made available at the property and the Mill (LAVANG Mill, Lavang Special, Rasan, Belian property). iv). There is Biodiversity Baseline Assessment Report for SOU 31 Lavang .. v) The impact assessment plan has been made available in the property and manual procedure has been done to monitor all activities. The human rights policy was made available and published on both the properties and the mill.

There is no land dispute in the sampled estates as their land titles have been legally identified and documented.

2.3.3 and 2.3.4

There is an implemented management plan that aims to achieve long term economic and financial viability

Use of the land for oil palm does not diminish the legal rights, or customary rights, of other users, without their free, prior and informed consent. The same status applied to Lavang Estate, Lavang Special Estate, Rasan Estate and Belian Estate. During the audit, it was seen that the Lavang Special, Rasan and Belian had documented a predicted 3 year business management plan.

For each estate and mill there is a respected person who is responsible for the budget and has the budget for the operation properly allocated before it is presented to management. The assistant manager of each estate was responsible for the document and assisted in the documentation of the budget. Rasan, Lavang Special and Belian: a 5-year replanting program is available from 2015 to 2020, divided into:

The documentation has been made available: Rasan and Lavang Special, and Belian: There is a replanting and new planting progress report for FY 2016/2017 and to date there about 51% of felling and ,27% of terrace construction and, 24% of foam /land formation and 51% plant palm.

Water management plan was available to provide clean water to staff and workers. Water quality has been maintained through river reserve protection where there is a clear policy and manual for water quality management plan. There are guidelines on river reserve management by Sime Darby, the guideline established is to standardize the management at the river reserve area and recommend the best practices to conserve river. In this guideline, the estate identified the river, demarcation, activities at the river reserve area and technical guidance on water sampling.

Department of Environment (DOE) license available for mill effluent treatment plant with POME application at composting plant. Estates respectively, Lavang Special, Rasan and Belian (through Bloi River, Pugang River and Lavang River) have conducted their quarterly river quality monitoring and reports were available. The average water consumption of the monitored mill has reached an average of 1.46 Liter/ton FFB at the moment.

Weed control, such as circular spraying, is carried out selectively, adapted to field conditions.

Based on the observation, there is a shopping center (Kedai Runcit), a community center (Dewan Lavang) and a mosque. Based on the field visit to the housing complex in Desa Lavang, the basic needs for workers' housing were in place. Based on interviews with the foreign workers from Indonesia at Lavang Special, Rasan and Belian Estate, they inform that there are informal workers who find solidarity among them as migrant workers and informal encounters depend on their needs.

Based on stakeholder consultations with the Gender Committee and migrant workers from Indonesia, which knows that, among other things, there was no discrimination. Based on the interview, a documented organizational chart is available for each estate and factory, consisting of the employees and staff, especially for the gender committee. Based on the interview with one of the general workers of Lavang Special (Marisa – 26 years old), the female workers understood that there were policies available regarding the reproduction of human rights.

Based on the conversation, the foreman has the right to and is responsible for receiving the complaint and communicating it to the highest level, including the assistant manager and manager of each property and mill.

Indicator 6.10.1 & 6.10.2

The policy was communicated to all levels of the workforce using the spoken method during muster training and displayed in the office. There was no community settlement around the plantation area, generally the Lavang complex area was within boundaries with another plantation in Sime Darby (Pekaka complex) and another plantation company. The contributions were implemented according to the proposal of the related party in the Lavang Complex (Workers and Teachers Committee).

Based on the sample of labor contract that has been signed by both migrant workers and the company's representative, if the early period of the contract will be valid for three years. It was explained in clause 23.3 that the employee terminates their contract within three years, the workers will manage their housing alone, the company will only contribute to their housing to go back to their agency. Interview with the migrant workers said that there was no employee who terminated their employment before their contract expires.

Summary of Assessment Report of Supply Chain Requirement

In that scenario, the mill can only claim the volume of oil palm products produced from processing the certified FFB as MB. The Lavang Palm Oil Mill has a mechanism for FFB acceptance into mills by separating FFB from own estate identified as certified FFB (RSPO certified) and from other sources that are not certified (RSPO non-certified). The table below has certified and non-certified FFB recorded in summary monthly FFB received.

Non-certified FFB is only supplied by Subis Sdn.Bhd that was identified as non-certified FFB. The estimated tonnage of CPO and PK products that can potentially be produced by the certified factory must be recorded by the CB in the public summary of the P&C certification report. Lavang Palm Oil Mill has the record of actual tonnage produced by CPO and PK (certified by RSPO).

Based on data of certified products from CPO and PK, the actual quantity produced in January to October 16, 2016 (current recertification audit) and the estimate of the certified product are described in the table below.

Documented procedures .1

The mill must also meet all registration and reporting requirements for the relevant supply chain through the RSPO Supply Chain Management Organization (RSPO IT Platform or Book and Requirements). The site must have written procedures and/or work instructions to ensure the implementation of all the elements specified in these requirements. Complete and up-to-date procedures covering the implementation of all elements of these requirements.

The management unit in Lavang Oil Mill (SOU 31 Sime Darby) has a work procedure as a guideline to ensure the implementation of all the necessary elements. This procedure is standard operating procedure for traceability and the RSPO Supply Chain Certification System (SOP No. 1, was revised in March 2013). SCCS training has been demonstrated for the responsible staff and related staff to implement the supply chain system.

Based on the observation of the field visit and the interview with the staff at the scale and sorting area and at the loading ramp, it was evident that the responsible staff understood the supply chain system management mechanism, which can demonstrate the sorting mechanism and prepare a daily report.

The responsible person is designated to ensure the operation of the factory based on the applicable procedure. He is Assistant Engineer Lavang Oil Mill and also RSPO/ISCC Representative for Palm Oil Mill on terms and conditions in accordance with Sime Darby Plantation of Mill Quality Management System (MQMS). The Lavang Palm Oil Mill has a fruit acceptance mechanism per driver to show FFB waybills from each core estate of SOU 31-Sime Darby (certified FFB) and FFB Dispatch Chit (non-certified FFB) from the other source. As of early 2015, Sime Darby Plantation Sdn Bhd (SDPSB) owns and operates 34 palm oil mills in Malaysia and, through their PT Minamas Gemilang subsidiary, 25 palm oil mills in Indonesia.

Sime Darby Plantation Sdn Bhd is a member of RSPO and has been involved in certification since 7 September 2004. Examples: “Group Employee Handbook”, last revised May 2014, explains to employees their benefits and company rules. Principal of Sekolah Kebangsaan Lavang Complex. The principal thanks the management of Sime Darby for their cooperation with the school regarding their assistance in terms of the school fund.

The building was built by Sime Darby management and the school teacher is from the government. There is a request from the school management to repair the toilet that was broken, and the request has been sent to sime darby management (September 2016). There is an issue raised by the canteen contractor due to discrepancy payment from Sime Darby.
