I NVITATION TO B ID

Philippine bidding documents may also be downloaded for free from the Philippine Government Electronic Procurement System (PhilGEPS) website and the procuring entity's website, provided that bidders must pay the non-refundable fee for the bidding documents no later than the submission of their bid . bids. I NSTRUCTIONS TO B IDDERS

The Procuring Entity mentioned in the BDS invites tenders for the supply and delivery of goods as described in Section VII. Government-owned or controlled corporations (GOCCs) may be eligible to participate only if they can demonstrate that they (a) are legally and financially autonomous, (b) operate under commercial law, and (c) are not agencies of attached to the Procuring Entity. The Government of the Philippines (GOP) has received only ten million and two hundred thousand and 00/100 pesos (Php) through the Corporate Fund Budget. The name of the project is: Supply and Supply of Two (2) Rice Combine Harvesters, Two (2) Agricultural Tractors 90 HP and One (1) Agricultural Tractor 35 HP.

For this purpose, similar contracts relate to the supply and delivery of rice harvesters, 90 HP agricultural tractors and 35 HP agricultural tractors. 12.1(a)(ii) Bidder's SLCC similar to the contract to be awarded should have been completed within the last two (2) years prior to the deadline for submission and receipt of bids. G ENERAL C ONDITIONS OF C ONTRACT

This contract shall be interpreted in accordance with the laws of the Republic of the Philippines. In the event that any subcontractor is found by the Procuring Entity to be ineligible, the subcontracting of such portion of the Goods shall be prohibited. At least one percent (1%), but not five percent (5%) of the amount of each payment shall be retained by the Procuring Entity to cover the Supplier's warranty obligations under this Contract as described in GCC Clause 17.

The performance guarantee remains valid until the contracting entity issues the certificate of final acceptance. The performance security may be released by the contracting entity and returned to the supplier after the issuance of the certificate of final acceptance under the following conditions: Any document, other than this Contract itself, which is enumerated in GCC Clause 14.1, remains the property of the Procuring Entity and must be returned (all copies) to the Procuring Entity after the Supplier's performance under this Contract has been completed, if required by the contracting entity. .

The ordering party must notify the supplier in writing and in a timely manner of the identity of any representatives retained for these purposes. The procuring entity shall immediately notify the supplier in writing of any claim that may arise under this warranty. Delivery of the goods and/or performance of services shall be made by the supplier in accordance with the schedule prescribed by the procuring entity in Section VI.

Supplier's liability under this Contract shall be as provided by the laws of the Republic of the Philippines, subject to the additional provisions, if any, set forth in the SCC. The Procuring Entity will terminate this Contract for non-performance when any of the following conditions are associated with its implementation: Before recovery is made, the fact of loss must be certified by the Supplier under oath to the satisfaction of the Procuring Entity before recovery is made.

All decisions recommended by the CTRC shall be subject to the approval of the HoPE. h).

S PECIAL C ONDITIONS OF C ONTRACT

If the Supplier is required under this Contract to transport the Goods to a specified destination within the Philippines, defined as the Project Location, transportation to such destination within the Philippines, including insurance and storage, as specified in this Contract , is arranged by the Supplier and the associated costs are included in the Contract Price.

When the supplier is required under the contract to deliver the goods CIF, CIP or DDP, the goods must be transported on Philippine registry carriers. The Supplier shall indemnify the Client against all claims by third parties for infringement of patent, trademark or industrial design rights arising from the use of the Goods or any part thereof.
