Delivery of the Goods must take place within the period stated in the Schedule of Requirements. A complete set of Bidding Documents may be obtained by interested bidders from the address below upon payment of the applicable fee for the Bidding Documents, in accordance with the latest guidelines issued by GPPB, in the amount of One Thousand Four Hundred Pesos (PhP 1,400.00) only. ). I NSTRUCTIONS TO B IDDERS
Government-owned or controlled corporations (GOCCs) may only be eligible to participate if they can establish that they are (a) legally and financially autonomous, (b) operating under commercial law, and (c) not affiliated agencies in the contracting entity. . B ID D ATA S HEET
The Government of the Philippines (GOP) through the 2020 Corporate Fund budget the amount of ONE MILLION FOUR HUNDRED PESOS ONLY (PhP. The price of the Goods will be quoted DDP, PhilRice, Maligaya, Science City or Munoz, Nueva Ecija.
16.1(b) Bid prices for goods supplied from outside the Philippines will be quoted in Philippine pesos. The amount of not less than 2% of the ABC, if the bid security is cash, cashier/manager's check, bank draft/guarantee or irrevocable letter of credit; or. Considering the limited access to financial institutions, regulatory and other offices as well as the implementation of government restrictions on transportation and travel, a statement of unnotarized bid security will be accepted. The end user may require the successful bidder to replace the submitted PSD with a performance bond in any of the forms prescribed under Section 39.2 of the 2016 Revised IRR of RA 9184 upon the lifting of the state of calamity or community quarantine or restrictions of similar as the case may be.
G ENERAL C ONDITIONS OF C ONTRACT
This contract shall be interpreted in accordance with the laws of the Republic of the Philippines. At least one percent (1%), but not more than five percent (5%) of the amount of each payment shall be retained by the Procuring Entity to cover the Supplier's warranty obligations under this Contract as described in GCC Clause 17. The performance security will remain valid until issuance by the Procuring Entity of the Certificate of Final Acceptance.
The performance security may be released by the contracting entity and returned to the supplier after the issuance of the certificate of final acceptance under the following conditions: The ordering party must notify the supplier in writing and in a timely manner of the identity of any representatives retained for these purposes. Delivery of the goods and/or performance of services shall be made by the supplier in accordance with the schedule prescribed by the procuring entity in Section VI.
The liability of the Supplier under this Contract shall be as determined by the laws of the Republic of the Philippines, subject to any additional provisions in the SCC. The contracting authority shall terminate this contract for breach of contract if one of the following conditions is attached to its performance: Before recovery can be made, the fact of the damage must be established by the Supplier under oath to the satisfaction of the Contracting authority before recovery can be made done.

S PECIAL C ONDITIONS OF C ONTRACT

The Goods remain at the risk and ownership of the Supplier until their final acceptance by the Contracting Authority. In the event that a Philippine Registry carrier is not available, the Goods may be shipped by a non-Philippine Registry carrier, provided that the Supplier obtains and submits to the Contracting Authority a certificate to that effect from the nearest Philippine consulate to the port of shipment. . The contracting entity assumes no liability for damage to goods during transport other than that prescribed by INCOTERMS for DDP deliveries.
In the case of Goods supplied from within the Philippines or supplied by local Suppliers, risk and title shall not be deemed to have passed to the Procuring Entity until their final receipt and acceptance at the final destination.
