PAYMENTS AGREEMENT
BETWEEN
THE REPUBLIC OF INDONESIA

THE POLISH PEOPLE'S REPUBLIC
With a view to facilitate and re gulate all authorized
current payments between the Republic of Indonesia and the Polish People's epublic, the Indonesian Government on the one part and
the Polish Government on the other part have come to the following
agreement :
Article 1
All current payments enumerated in Article
4
of thisAgreement between Indonesia and Poland shall be effected in pounds sterling in accordance with the stipulations of this Agreement.
Article 2
For this purpose De Javasche Bank, acting on behalf of the Government of the Republic of Ind onesia will open in the name of the Narodowy Bank Polski, acting on behalf of the Government of the Polish People's Republic a non-interest bearing account ih pounds· sterling styled tt Polish Account 0•
The Narodowy Bank Polski, acting on behalf of the Government of the Polish People's Republic, will open in the name of De Javasche Bank, acting on behalf of the Government of the rlepublic of Indonesia a non-interest bearing account in pounds sterling styled 11 Indonesian Account 11 •

All authorized current payments from Indonesia to Poland as enumerated in Article
4
effected by order of authorized Foreign Exchange Banks in Indonesia, shall be debited to the 11 IndonesianAccount 11 with the Narodowy Bank Polski. On the same day the entry is made the Narodowy Bank Polski shall forward to De Javasche Bank an advice of debit in respect of the ー。セMュ・ョエ@ effected.
All authorized current payments from Poland to Indonesia as enumerated in Article 11. effected b y order of authorized Foreign l!:xchange Banks in l)oland shall be debited to the 11 Polish Account n
with De Javasche Bank. On the same day the entry is n1ade De Javasche Bank shall forward to the Narodowy Bank Polski an advice of debit in respect of the payraent effected.

4

2. expenses of セ QQ@ kinds in connection with the exchange of goo<ls, such as transport cliarges, insuran ce, arbitration awards, ware-ho1J.sing and cuRtoms fees, ni.anufactllring, processing, repair and o t'rier eos ts;
3 . .
other curr ent p ayments are :a. eYpenses and profits of transit transactions; b . harbour and 」。セ。ャ@ dues;
c. rights and emoluments of patents, licences, trade marks and other rights;
d . expenses of commercial representation, adverti.sine;, commission, r emuneration and brokeraee ;
e . other payments on which the two Banks of Issue may agree.
Above mentioned payments sball be submitted to the Foreign Fxcl-ianee .Control re gulations in force durinc the ralidity of this Acreement in In j onesia and in Poland respectively.
Article

If at any time the "Indonesian Account" and the "Polish Account" show an overall net-balance in exces 8 of £ 200, OCO (two hundred thousand pounds sterline), such exce3s shall on demand of the creditor bank be puid immedia Q セ・ャケ@ by tho debtor be..nk in effective pounds sterling to the creditor bank.
Article

For the purpose of this Agreement all contracts and invoices relating to trade between Indonesia and Poland shall be expressed in pounds sterling.
If within the frame-uork of this Agreement in exceptional
cases such as : consignments, auctions, fairs etc., Rupiahs or Liloty•s must be used in s11ch documents , conversion into pounds sterling shall
take place at the for the creditor most favourable applicable official exch un{Se rate of pounds sterling quoted by De Javasche Bank or the Narodowy Bank Polski respectively.
If any other currency is used in such docUTients it shall be converted セョセ ッ@ pounds ウエ・イャゥョ セ@ at t he official medium rate of exchange practised セケ@ the creditor bank on the day of payments .

All payments for goods will be effected in -che form of

Account n shall be debited at the moment when payments are effectuat-ed under such creffectuat-edits.
reither the Narodowy Bank Polski nor De Javasche Bank will make any charges for services regarding the maintenance of the
11 Indonesian Account 11 and the 11 Polish Account 11 respectively.
Article
8
De Javasehe Bank and the Narodowy Bank Polski shall by mutual agreement, establish all technical details necessary to the
effective functioning of the present ae;reement.
Article
9
A. Settlement of the Accounts shall take place annually as of
the SッエセQ@ April unless se t;tlement is waived by the creditor in
viri ting before the 1st hay .
B. A."'or the purpose of establis1.1ing the net-balance the total of the debit entries made into the 11 Indonesian Account 11 on account
of effective payments and the total of the debit entries made into the 11 olish ccount n on account of effective payments, as
evidenced by the respective statements of the accounts as of 30th April of each annual period, will be off set against each other and the resultine net-balance will be settled in accor>dance with the stipulations paragraph C below .
C. The net-balance of the accounts determined in accordance with the provisions para.graph A and paragraph B above shall be settled by the debtor either by means of additional exports of goods agreed upon between the Contracting Parties or by transfer of effective pounds sterling at the election of the creditor.
D. In the event settlement is made by goods, delivery of such goods shall be made aa soon as possible but not later than

(six) months after the order has been placed; in t h e event of ウ・エセャ・ュ・ョエ@by monetary transfer, sucn transfer shall take place on demand of the creditor as soon as possible but no:b later than 30 (thirty) days after the demand is made .
Article 10
L""l the event of termination of this Agreement , the followiri..g stipulations will be in force :
A. The net-balance of the accounts determined in accordance with the provisions of Article
9
paragr-aph B as of the effective date of termination shall be settled in accordance with the provisions of Article9
paragraph C.·,·.
B. After settlement in accordance with paragraph A of this Article only payments lU1der contracts end commitments outstanding on the effective date of the termination of this Agreement for which
payments the provisions of this Agreement s h all remain valid, shall be permitted to be entered into accounts which will be reopened for
t ;1is purpose only.
c.
However , the settlement of the outstanding contracts andcomr1i tments, payment of which will not have been completed wi thin a period of three months after the effective date of the termination of this Agreement shall be re-negotiated by both parties as to the i mplementation of the payments thereof, with due regard to the terms and conditions of the underlying contracts.
D. The net-balance of the reopened accounts as of the end of the t h ird month after the e f fective chte of the t ermination of this Agreement, as far as accrued in accordance with p 2ra.graph B of this Article , shall be due and paye.ble on demand in effective p ounds sterling , with in fourteen days.
Article 11
This Ae;reement s hall remain in f orce for a period of one セイ・。イ N@ In case neither of the Parties s 'riall have given n otice three months before the expi;riat:;ion of t h e said period of its intentio n to terminate
the Agr-eement, it will b y tacit illlderstanding be prolonged eac'l-i time for another period of one year.
The provisions set forth above shall be provisionally applied retroactively from 1st May
1953

In the course of our negotiations it has been agreed, that in view of the potential possibilities the exchange of goods between both countries can reach a far lare;er volume than specified in the present Agreement .
Considering this the Government of the Republic of Indonesia is in principal prepared to grant licences for additional exports of the goods mentioned in List I which will be covered either by additional exports of Polish goods as mentioned in List II or by payments in effective pound sterling or in any other way acceptable to the Indonesian Government.

11 In the course of our negotiations the Indonesian
11 Delegation raised the question of transit- transactions
n b:,r which is understood the imports of goods from Poland
11 to Indonesia to be delivered or reexported to a t !iird 11 country . 11
11 Understanding has been reached between the two Parties to
u the effect that the transit - transactions , if approved by
11 the authorities of both sides, will form part of the Trade
11 and Payments Agreemenb concluded on May
6, 1953 .

11 t!1ousand pounds sterling) shall cover the following
11 commodities :
