Tender – a signed tender or proposal for the conclusion of an order submitted by the tenderer in response to and in accordance with the requirements of the tender documents. Bidder - Refers to a contractor, manufacturer, supplier, distributor and/or consultant who submits a bid in accordance with the requirements of the tender documents. Tender documents - Documents issued by the client as a basis for bids and containing all the information a potential bidder needs to prepare a bid for goods, infrastructure projects and/or consulting services requested by the client.
Consultancy Services – Refers to services for infrastructure projects and other types of projects or activities of the IDP that require sufficient external technical and professional expertise beyond the ability and/or capacity of the IDP to undertake such as, but not limited to: (i ) advisory and review services; (ii) pre-investment or feasibility studies; (iii) design; (iv) construction supervision; (v) management and related services;. Contractor – is a natural or legal entity whose proposal has been accepted by the Procuring Entity and to whom the Contract to perform the Work has been awarded. Foreign-financed procurement or foreign-aided project – Refers to procurement whose funding source is from a foreign government, foreign or international financing institution as specified in the Treaty or International or Executive Agreement.
Goods – Refers to all items, supplies, materials and general support services, other than consulting services and infrastructure projects, that may be required in the transaction. A procurement project will be described, detailed and scheduled in the Project Procurement Management Plan prepared by the agency, which will be consolidated into the procuring entity's Annual Procurement Plan.

The client will hand over the entire construction site or its parts to the contractor based on the delivery schedule specified in the SCC corresponding to the execution of the works. If possession of the work is not given by the above date, the client will be deemed to have postponed the start of the relevant activities. The Employer will only approve any proposed replacement of key personnel if their relevant qualifications and abilities are equal to or better than those listed in the Schedule.
By entering into the contract with the contracting entity, the contractor acknowledges the right of the contracting entity to take action in accordance with RA No. All debts of the GOP in its favor will be settled for recovery of costs.
