ARTICLE 2
( 1) Each Co.;,t.ractinG Party grants to the other

(4) Each Contrac1inG Party shall have the rigtt to
refuse to accept the desit,;rrntion of an airline and to withhold セイ@ revoke セエ」@ grant to an airline of the privi1egei3 specif.i<.:d in parat;re.ph (2) o'' Article 2 of the present Aeree1:;1.:nt or to i1r1pose ::.;uch conditions as

that substantial ownership and effective control of
that airline are vested in the Contracting Party

(5) At any time after the provisions of paragraphs (1) and (2) of this Article and of paragraph (1) of Article 8 have been complied with, · an airline so designated and authorised may 「・ァゥセ@ to operate the agreed services, provided that a ウセイカゥ」・@ shull not be Oferuted unless a
tariff is . in force in respect of it ・ウセ。「ャゥウセ・、@ in

accordance with the provisions of Artiplc 7 of the
present Agreement. ;:
(6) Each cッョエイ。」エゥョセ@ ?arty shall ィセカ・@ the right to revokE; an opei·atinE autho.:::ization or to suspend the exercise by :an airlir.e · of the privileges specified in paragraph (2) oi Article 2 of セィ・@ present Agreement or to impose such conditions as it may deem necessary on· tte ・ク・イセゥウ・@ by セョ@ 。ゥイャゥセセ@ of those privileces in
any case where the セ ゥイャゥョ・@ fails to comply with the · laws and ᄋイ・ァオャ。エゥッョセ [@ 1Jf the Cor. tracting Party granting
those ーイゥカゥセセァ・ウ@ or otherwise fails to operate in
accordance with the conditions prescribed in the ーイ・ウ・セエ@
Agreement; provided that, unless immediate revocation, suspension or impos i tion of the conditions is essential to prevent further :Lnfringemcnts of laws ·or regulations,

AllTICLE 5
(1) Aircraft operated by a designated airline 0£
either Contractinc Party and enterinb, departing 。ァ。ゥセ@
from, or flying ncross the territory of the other
Contractin6 Party, as well as fuel, lubricants, spare
parts, regular equipment and aircraft atores on boarti
. 1 such aircraft, shall be exerapt from customs duties a:-J5
other charges levied on tLe occasion of importation,
exportation or transit or goods. This shall also 。ーセャケ@
to goods on 「ッィイセ@ the aircraft consuoed during the
flight across the territory of the latter Contractinc
Party.
(2) Fuel, lubricants, aircraft stores, spare parts
and regular eqi1i ーセョ・ョ@ t, temporarily imI?ort ed into the
territory of either Contracting Party, there to be
immediately or after storage installed in or otherwise
taken on 「ッ。イ \セ@ the aircraft of a desit;nated airline of
the other Contractine:; Party, or to be other·;,ri.se exported
again from the territory of the former Contracting p。セエケL@
shall be exempt from the customs duties and other charges
mentioned in paragraph (1) of セィゥウ@ Article.
(3) Fuel and ャセ「イゥ」。ョエウ@ taken on board the aircraft
of a designated airline of either Contracting Party in the territory of the other Contracting Party ar..d used
in international air services, shall be exempt ヲイッセ@ the
customs duties and other charges mentioned in paragraph
( 1) of this aNイエゥ」セ・L@ as well as from any other specia::
consumt: ti on chtl;t'ges, . provided that forr.1al cus to:ns
regulations are complied with.
(4) Each Contractin£ Party may ォ・・セ@ the goods
mentioned in ーョNイ」 Z セイ。ーィウ@ (1) to (3) . of this NmNイエゥセャ・@
under customs セオーオイカゥウゥッセ@ or control.

In so far as no duties ' 01 · other charges areimposed on goods mentioned in paragraphs (1) to (3)
of this Article, such goods shall not be subject to
any economic p:rohibitions or restrictions on ir:lportation, exportation and _ transit that may otherwise be applicable unless such prohibition or restriction applies to all
airlines

interest of the eirlines of the other Contracting Party
so as not to affect unduly the services which the latter
provides on the-whole or part of the ウXセ・@ routes •

services provided by the designatedairlines of the Contracting.Parties shall セ・。イ@ close
relationship to the requireucnts of the public for
transpo=tatlon on the . specified routes and shall have
as their primary objective the ーイッカゥウセッョL。エ@ a
reasonable load ヲセ」エッイL@ of capacity adequate to meet
the current and r1:n.uonably anticipo.ted requin:::1ents
for the carriage of passengers, mail and cargo
originatinc from or destined for the territory of
the Contracting NpゥZセN[Zエケ@ which has designated the airlir! •;E.

accordance with the t;eneral principles that capacity shall be related to:
( i) th"c requirements of traf fie to and from the territory of the Contracting Party which has designated the airlines;
(ii)
(iii)
traffic r ·equirenen ts of the area through whi ct
the airlines pass, after エ。ォゥョセ@ account of
other transport services estatlished by airlines
of the States comprisin6 the area; und
the requireuents of through airline operation.

ARTICLE
1
(1) The tariffs on any aGreed service shall be
established at イ・。ウッョ。「ャセ@ levels, due イ・セ。イ、@ being
paid to all relevant factors such as cost of ッー・イ。エゥ」セL@
reasonable profit,· the characteristics of the various
routes and the ta.riffs charged by any other airlines
which operate over the same routes or parts thereof.
In ヲゥクゥョセ@ such tariffs, the provisions ッセ@ the followinb
paragraphs should 1>:' observed .
(2) The tariffo referred to in paragrar:-h(1) of this
Article, shall, if possible be agreed in イ・セー・」エ@ of each
of the specified routes between the designated airlines concerned, in consultation with other airlines operatifig over the whole or pn.rt of that route, and su.ch agreement
shall be reached throut;h the rate fixing machinery of . J .
the Inte.cnational jセZゥイ@ Transport Assoc_iation.
The tariffs so agreed shall be subject to the approval of the aeronautical authoritie8 of both Contracting Parties.

(3) If the 、N・ウゥセZョ。エ・、@ airltnes cannot. agree on
any of these tariff8, or if for some other reason-a
tariff cannot be agreed :in accordance with the
provisions of paragraph (2) of this Article, the

shall try to deter;nine エィセ@ tariff by agreement be·tween
themselves.
(4) If the aeronautical authorities cannot agree
on エィセ@ approval ni Rny tariff セオ「イョゥエエ・、@ to エィ・セ@ under
paragruph (2) of t.his Article or on the determinat.ion
of any tFlrif.f' under paragraph (3), the dispute shall be
settled in 。」」ッイᄋcZゥNセョ」・@ with the p.covis1 ons of Article 1 O
of the ーイ・セ・ョエ@ aセイ・・lャ・ョエN@
(5) Subject to the provisions of paragraph (4) of
this aセエゥ」ャ・L@ no セ。イゥヲヲ@ shall 」ッイョセ@ into force if
,the aeronautical &uthorities of either Contracting
Party have ョッセ@ approved it.
(6) The tari.ffu establishe1.: in 。」」ッャᄋ、。ゥセ」・@ with

until new tariffs have been established in 。」」ッイ、セAc・@

ARTICLE 8
(1) The desicnated airlines shall 」ッイョュオョゥ」Fセ・@ to
the aeronautical irn thori ti1.:s of both Contracting Parties
not later than th:Lr·ty days prior to the inauguration
of air services on the routes specified in accordance
with paragraph (3) of Article 2 of the present aァイ・・セ・ョエ@
the type of service, the types of セゥイ」イ。ヲエ@ to be used
and the .flight schedules. Thia shall likewise apply
to later changes.

(2) The aeronautical authorities of each ContrnctinG
'Party shall supply to the 。・イッョ。オエゥセ。ャ@ authorities of
the other cッョエイ。」セゥョァ@ Party at their request such

destinations of such traffic.

Contracting Parti8B in order to achiiJve close cooperation

(2) Consultation may be requested at any time by either Contrnctinb P2-rty for the purpose of discussin£ amendments to the present Ai;reer:1e;,t or to the Route
Schedule, The same Rpplies to discussions concerning the
interpretation and application of the present aァイ・・イョ・ヲゥセ@
