인권이사회는
2006년 설립 이후부터 지금까지 인권의 보장과 개선
을 위해 부단히 노력해왔다. 2007년에는 제도구축 결의를 통해 주요 제도를 마련하고 2011년에는 재검토 결의를 통해 이를 공고화시켰다.비록 2011년 재검토 결의가 인권이사회의 제도 개선과 개혁의 기대에 는 미치지 못했지만, 재검토 과정을 통해 그동안의 인권이사회의 임무 수행을 총체적으로 평가하고, 문제점과 한계를 밝히며 좀 더 실효적이 고 효율적인 임무 수행을 위한 방안을 모색하는 좋은 기회가 되었다.
인권이사회가 국제적 인권보호의 중심 기관으로서의 역할을 제대로 수행해나가기 위해서는 보편적정례검토, 특별절차, 진정절차 등의 주 요 제도가 2006년 설립 당시 기획한 바대로 운영되고 있는지에 대해 지속적으로 평가하고 인권이사회 및 국가의 이행을 도모하기 위한 제 도 개선의 노력을 계속해나가는 것이 필요하다. 특히, 2012년부터 시 작된 제2주기 보편적정례검토에서는 제1주기의 권고사항에 대한 이행 여부를 함께 검토하고 있어, 이 제도가 국내 및 국제 인권상황을 얼마 만큼 개선했는지를 평가할 수 있게 되었다. 북한 역시 제2주기 검토가
2014년 4〜5월에 예정되어 있어 제1주기 검토에서 지적되었던 권고
사항들의 이행과 개선 여부에 관심이 쏠릴 것이다. 북한이 북한인권특 별보고관이나 북한인권 조사위원회 등에 대해 강한 거부감을 보이는 반면 비교적 보편적정례검토 제도의 참여에 대해서는 긍정적 태도를 보이고 있어 제2주기 검토는 북한의 인권 개선 의지를 평가하는 중요 한 기회가 될 것이다. 특별절차의 경우는 인권 문제를 조사, 감시하는 데 있어 현장방문이나 정보의 제고 등 관련 국가의 협조가 절대적이다.
유엔회원국의 절반 정도가 특별절차수임자에 대해
‘상시초청권’을 발
부하고 있지만, 북한을 비롯한 주요 인권 문제국가들은 현장방문과 정 보의 제공을 거부하고 있다. 특별절차의 협조 유무는 보편적정례검토 과정에서도 자주 다루어지는 주제인 만큼 다른 국가의 발언이나 인권 이사회의 권고를 통해 관련 국가의 협조를 도모할 수 있다.
인권이사회의 역할과 운영을 통해 국제적 인권보호를 향상하기 위 해서는 적절한 제도의 마련이 기초가 되어야 하겠지만, 더 중요한 것은 제도의 실효적 운영을 통해 제도의 목적과 원칙을 실현하는 것이며 이 것은 국가의 인권 의지에 달려 있다. 국가들은 인권 문제를 다룸에 있 어 정치적 집단행동을 자제하고, 인권이사회 및 국가간 협력을 지속적 으로 강화해 나가야 할 것이다.
