I NVITATION TO B ID

The complete set of tender documentation can be collected by interested bidders from 11/03/2020 (Wednesday) to 31/03/2020 (Tuesday) by 10:00 a.m. at the address below and upon payment of the applicable fee for the tender documentation in accordance with the latest guidelines issued by GPPB, in the amount of five thousand Philippine pesos (Php 5,000.00). All tenders must be accompanied by a tender bond in any acceptable form and in the amount specified in clause 18 of the ITB. Bids will be opened in the presence of bidder representatives who will decide to participate at the address below.

I NSTRUCTIONS TO B IDDERS

Bidder's SLCC statement similar to the contract to be offered, in accordance with ITB Clause 5.4. Any other document related to the financial component of the offer as stated in the BDS. a). Unless otherwise specified in the BDS, payment of the contract price shall be made in Philippine Pesos.

B ID D ATA S HEET

Contract Locations: KSU Main Campus, National Highway, Purok 6, Bulanao, Tabuk City; and Rizal Campus, Brgy. The name of the project is Package contract for the improvement or rehabilitation of sponges, old Tech-Voc and computer laboratory buildings. 5.4(b) For this purpose, similar contracts shall refer to contracts which have similar main categories of work such as repair/renovation/upgrade of one-story building, of similar size and equal to at least fifty percent (50%) of the ABC of 853,912, 62 Php.

G ENERAL C ONDITIONS OF C ONTRACT

The Completion Date is the date of completion of the Work as certified by the Contracting Entity's representative in accordance with GCC Clause 49. All materials and plant on site shall be deemed to be the property of the Contracting Entity. The contractor must carry out all instructions of the procuring entity's representative complying with the applicable laws where the site is located.

The performance bond remains valid until the client issues a certificate of final acceptance. The Client shall terminate this Agreement for default if any of the following conditions are met: All drawings prepared by the Contractor for the execution of temporary works must be pre-approved by the Client's representative prior to use.

The approval of the client's representative does not change the contractor's responsibility for planning the temporary works. The contractor obtains the consent of third parties for the planning of temporary works, if requested by the client. Each completed form must be checked and signed by the customer's representative within two days after the work has been completed.

The Procuring Entity's Representative's approval of the Work Program will not change the Contractor's obligations. Such request for payment shall be verified and certified by the Procuring Entity's representative/project engineer. The Contractor shall submit monthly statements of the estimated value of the work performed less the cumulative amount previously certified to the Procuring Entity's Representative.

S PECIAL C ONDITIONS OF C ONTRACT

The duration of the contract is counted from the start date (NTP) and not from the effective date of the contract. Quality Control Engineer 'Same post on similar works' covers general work experience for the appointee. If the proposed key technical personnel are employed by the Bidder and are working on another project at the same time as the bid is submitted, the Bidder must provide certification that (1) the personnel will be withdrawn from the current project when the Bidder is awarded the contract and (2) they will be replaced by another person with equal or better qualifications, as confirmed by the head of the executive office.

The tenderer may propose a key technician who is not its employee, provided that the said personnel must provide a declaration that he/she will work for the tenderer if awarded the contract under tender. 7.4(c) The performance security shall cover the period from the time of signing the contract until the final acceptance of the project by the Government, during which the warranty period as prescribed in Sec. For this reason, the coverage of the performance guarantee shall include the fault liability period of one (1) year and shall not become due for release until the head of the procuring entity has issued the certificate of final acceptance.

Note: Tenderer's performance/deposit guarantees submitted by the contractors will be subject to verification/confirmation as to validity and authenticity at the head office of the issuing bank or insurance company. The bidder submits a confirmation letter, duly authenticated by the relevant bank or insurance company. If no Site Investigation Report prepared by the contracting authority is available, the tenderer will conduct a site visit prior to preparing its bid.

13 If the Contractor is a joint venture, "all partners of the joint venture shall be jointly and severally liable to the Procuring Entity."

S PECIFICATIONS

Kalinga State University will hire a qualified construction company for construction services to improve the mushroom building of KSU State University. In this regard, the contractor or the key personnel to be assigned to him must have professional experience compatible with the undertaking as specified in point 12.1(b)(ii.2) of the tender information form. The contractor will, with the consent of the proponent, prepare any revised major changes/changes to the project during construction.

The contractor shall fully address and comply with the final list of works to be issued by the KSU Infrastructure unit prior to the Handover and Acceptance of the completed project. The Contractor shall clean the entire area by removing debris, spills, paint stains, excess and spills and shall leave the entire premises free of debris caused by their work to the satisfaction of KSU at no additional cost. He shall take responsibility for this and the Contractor shall be particularly liable for any liability arising therefrom.

Above or equal to (15%) of the Contract Price less prepayment (Section 10.2), applicable withholding taxes and. In the event of early termination, Contractor shall be notified by KSU within thirty (30) calendar days prior to such termination. Failure to fulfill any of the above responsibilities will be at the risk of the relevant Bidder. Unless otherwise specified in the BDS, the Bidder may subcontract portions of the Works to an extent approved by the Procuring Entity and stated in the BDS. In the event that any subcontractor is found by the Procuring Entity to be ineligible, the subcontracting of such portion of the Works shall not be permitted.

Decisions made by the BAC to amend any provision of the bidding documents must be issued in writing through a Supplemental/Bid Bulletin at least seven (7) calendar days before the deadline for submission and receipt of bids. Prospective Bidders may request clarification(s) about and/or interpretation of any part of the Bid Documents. Supplementary/bid bulletins may also be issued at the initiative of the procuring entity for the purpose of clarifying or amending any provision in the bid documents no later than seven (7) calendar days before the deadline for submission and receipt of bids.

The Bidder shall enter rates and prices for all items of the Works described in the Bill of Quantities. Bids shall remain valid for the period specified in the BDS which shall not exceed one hundred twenty (120) calendar days from the date of opening of tenders. The bid security described in ITB Clause 18 must also be extended corresponding to the extension of the validity period of the bid.

The Procuring Entity shall prepare minutes of the tender opening proceedings which shall include, at a minimum: (a) the names of the tenderers, their tender price (per lot, if applicable, and/or including discount, if any) , the security offer, the findings of the preliminary examination and whether there is a withdrawal or modification; and (b) the attendance sheet. The abstract of the bids read and the minutes of the opening of the bids will be made available to the public upon written request and payment of a certain fee to recover the cost of the materials. The notice will be issued within seven (7) calendar days from the date of opening of bids.

When applicable, the BAC will conduct post-qualification of the bidder with the next lowest calculated bid. A request for reconsideration may be filed by the bidder with the HoPE pursuant to Section 37.1.3 of IRR RA 9184. If the source of funds for the project has been withheld or reduced through no fault of the procuring entity.

The Contractor shall submit to the Procuring Entity for consent the name and details of the person authorized to receive instructions on behalf of the Contractor. The performance security may be released by the Procuring Entity and returned to the Contractor upon the issuance of the Certificate of Final Acceptance subject to the following conditions:. In the event of the Contractor's insolvency, any Contractor's Equipment that the Procuring Entity instructs in the notice must be used until the completion of the Works;.
